A BILL FOR AN ACT

CONCERNING THE AUTHORITY OF SHERIFFS OVER DEPUTY SHERIFFS.

Specifies that only deputy sheriffs in supervisory positions responsible directly to the sheriff or undersheriff whose duties include the implementation of policies and procedures for the sheriff's office shall serve at the pleasure of the sheriff.


Be it enacted by the General Assembly of the State of Colorado:

SECTION 1.  30­10­506, Colorado Revised Statutes, 1986 Repl. Vol., is amended to read:

30­10­506.  Deputies ­ liability of sheriff.  Each sheriff may appoint AND DIRECT as many deputies as he THE SHERIFF may think proper. for whose official acts and those of his undersheriff he shall be responsible, and may revoke such appointments at his pleasure. Persons may also be SPECIALLY deputized by such THE sheriff or undersheriff in writing to do particular acts; the sheriff and his THE SHERIFF'S sureties shall be responsible on his THE SHERIFF'S official bond for the default or misconduct of his THE undersheriff and deputies. DEPUTIES IN SUPERVISORY POSITIONS RESPONSIBLE DIRECTLY TO THE SHERIFF OR UNDERSHERIFF WHOSE DUTIES INCLUDE THE IMPLEMENTATION OF POLICIES AND PROCEDURES FOR THE SHERIFF'S OFFICE SHALL SERVE AT THE PLEASURE OF THE SHERIFF.

SECTION 2.  Safety clause.  The general assembly hereby finds, determines, and declares that this act is necessary for the immediate preservation of the public peace, health, and safety.
