HOUSE BILL 97­1162

CONCERNING THE REPEAL OF CERTAIN FUTURE REPEAL DATES WITH RESPECT TO THE REGULATION OF PETROLEUM STORAGE TANKS.

Be it enacted by the General Assembly of the State of Colorado:

SECTION 1.  8­20­201 (1), (2.3), (2.5), (2.7), and (4.5), Colorado Revised Statutes, 1986 Repl. Vol., as amended, are amended to read:

8­20­201.  Definitions ­ repeal. As used in this part 2, unless the context otherwise requires:

(1) (a)  "British thermal unit" or "BTU" means a scientific unit of measurement equal to the quantity of heat required to raise the temperature of one pound of water one degree Fahrenheit at approximately sixty degrees Fahrenheit.

(b)  This subsection (1) is repealed, effective July 1, 1997.

(2.3) (a)  "Gallon equivalent" means either a gallon diesel equivalent or a gallon gasoline equivalent.

(b)  This subsection (2.3) is repealed, effective July 1, 1997.

(2.5) (a)  "Gallon diesel equivalent" means an amount of a motor fuel that contains an average lower heating value of one hundred twenty­eight thousand BTUs (British thermal units), but in no case contains a lower heating value of less than one hundred twenty­four thousand BTUs.

(b)  This subsection (2.5) is repealed, effective July 1, 1997.

(2.7) (a)  "Gallon gasoline equivalent" means an amount of a motor fuel that contains an average lower heating value of one hundred fourteen thousand BTUs (British thermal units), but in no case contains a lower heating value of less than one hundred ten thousand BTUs.

(b)  This subsection (2.7) is repealed, effective July 1, 1997.

(4.5) (a)  "Motor fuel" means any liquid or gas used as fuel to generate power in engines or motors.

(b)  This subsection (4.5) is repealed, effective July 1, 1997.

SECTION 2.  8­20­206.5 (5), Colorado Revised Statutes, 1986 Repl. Vol., as amended, is repealed as follows:

8­20­206.5.  Environmental response surcharge ­ repeal. (5)  This section is repealed, effective July 1, 1997.

SECTION 3.  8­20­232.5 (5), Colorado Revised Statutes, 1986 Repl. Vol., as amended, is repealed as follows:

8­20­232.5.  Method of sales of motor fuels ­ gallon equivalents ­ conversion factors. (5)  This section is repealed, effective July 1, 1997.

SECTION 4.  Safety clause. The general assembly hereby finds, determines, and declares that this act is necessary for the immediate preservation of the public peace, health, and safety.
