A BILL FOR AN ACT

CONCERNING THE ELIMINATION OF THE REQUIREMENT THAT SURVIVOR BENEFITS PAYABLE TO A SURVIVING SPOUSE UNDER THE PUBLIC EMPLOYEES' RETIREMENT SYSTEM BE TERMINATED UPON THE REMARRIAGE OF THE SURVIVING SPOUSE.

Abolishes the requirement that survivor benefits payable to a surviving spouse under the public employees' retirement system be terminated upon the remarriage of the surviving spouse.


Be it enacted by the General Assembly of the State of Colorado:

SECTION 1.  24­51­912 (4), Colorado Revised Statutes, 1988 Repl. Vol., is repealed as follows:

24­51­912.  Termination of survivor benefits. (4)  Survivor benefits paid as surviving spouse's benefits pursuant to the provisions of section 24­51­909 shall terminate upon the remarriage of such spouse.

SECTION 2.  Applicability.  The elimination of the requirement that surviving spouse benefits be discontinued upon remarriage shall apply to remarriages occurring on and after July 1, 1997. This act shall not have the effect of reviving any surviving spouse benefits that were discontinued prior to July 1, 1997, because of the surviving spouse's remarriage.

SECTION 3.  Safety clause.  The general assembly hereby finds, determines, and declares that this act is necessary for the immediate preservation of the public peace, health, and safety.
