A BILL FOR AN ACT

CONCERNING AGES THAT RELATE TO THE CRIME OF SEXUAL ASSAULT ON A CHILD.

Current law defines the victim of the crime of sexual assault on a child as a person less than 15 years old and provides that the actor be at least 4 years older than the victim. The bill would raise this maximum age of the victim to a person under the age of 16 and reduce the age difference between the actor and the victim to 3 years.


Be it enacted by the General Assembly of the State of Colorado:

SECTION 1.  18­3­405 (1), Colorado Revised Statutes, 1986 Repl. Vol., is amended to read:

18­3­405.  Sexual assault on a child.  (1)  Any actor who knowingly subjects another not his or her spouse to any sexual contact commits sexual assault on a child if the victim is less than fifteen SIXTEEN years of age and the actor is at least four THREE years older than the victim.

SECTION 2.  Effective date ­ applicability.  This act shall take effect July 1, 1997, and shall apply to offenses committed on or after said date.

SECTION 3.  Safety clause. The general assembly hereby finds, determines, and declares that this act is necessary for the immediate preservation of the public peace, health, and safety.
