A BILL FOR AN ACT
CONCERNING PAYMENT TO PERSONS SERVING ON BOARDS OF
EDUCATION.

Beginning fiscal year 199798, provides for
members of the state board of education and school district boards
of education to receive a per diem and a reimbursement for expenses.
Specifies that the per diem and expenses are paid from state
funds, distributed to each school district by the department of
education in accordance with rules adopted by the state board
of education.
Be it enacted by the General Assembly of the State of Colorado:
SECTION 1. Legislative declaration. The general assembly hereby recognizes that the policymaking efforts and contributions of the state board of education and the school district boards of education throughout the state are critical to the operations of the state public school system. Further, the general assembly recognizes that dedicated and effective service on either the state board of education or a school district board of education requires board members to contribute many hours of work in addition to attendance at board meetings and that many board members are prevented from successfully maintaining other employment during their terms as board members. The general assembly also finds that providing incentives for capable, effective persons to serve on the state board or school district boards of education is crucial to ensuring that these bodies function successfully and that they adequately reflect the social, cultural, ethnic, economic, and gender distribution of the state population. Therefore, to encourage the most capable people throughout the state to consider service on the state board of education or a school district board of education, the general assembly adopts this act providing for payment from state moneys of per diem and reimbursement for expenses for persons serving on the state board of education or a school district board of education.
SECTION 2. 222105 (3), Colorado Revised Statutes, 1995 Repl. Vol., is amended to read:
222105. State board
composition compensation. (3) Except
as provided in subsection (1) of this section, members shall be
elected for terms of six years. They
shall serve without compensation but

EACH MEMBER SHALL RECEIVE A PER DIEM OF NINETYNINE DOLLARS
FOR EACH DAY ON WHICH THE STATE BOARD MEETS AS A BODY. IN ADDITION,
MEMBERS shall be reimbursed for any necessary expenses incurred
by them in the performance of their duties as members.
SECTION 3. 2232104 (5), Colorado Revised Statutes, 1995 Repl. Vol., is amended to read:
2232104. Organization of
board of education compensation.
(5) The secretary, assistant
secretary, treasurer, and assistant treasurer may be compensated
for their services in such capacities in an amount determined
by the board of education, but the president and vicepresident
shall receive no compensation for their services in such capacities.
All officers shall be reimbursed for necessary expenses incurred
in the performance of their duties in an official capacity.
BEGINNING FISCAL YEAR 199798 AND FOR EACH FISCAL YEAR THEREAFTER,
EACH MEMBER OF A SCHOOL DISTRICT BOARD OF EDUCATION SHALL RECEIVE
A PER DIEM OF NINETYNINE DOLLARS FOR EACH DAY ON WHICH THE
SCHOOL DISTRICT BOARD OF EDUCATION MEETS AS A BODY. IN ADDITION,
SCHOOL DISTRICT BOARD OF EDUCATION MEMBERS SHALL BE REIMBURSED
FOR ANY NECESSARY EXPENSES INCURRED BY THEM IN THE PERFORMANCE
OF THEIR DUTIES AS MEMBERS. PER DIEM AND EXPENSES REQUIRED TO
BE PAID PURSUANT TO THIS SUBSECTION (5) SHALL BE PAID FROM STATE
MONEYS ANNUALLY APPROPRIATED TO THE DEPARTMENT OF EDUCATION.
THE DEPARTMENT SHALL DISTRIBUTE SAID MONEYS TO SCHOOL DISTRICTS
PURSUANT TO WARRANTS SUBMITTED BY EACH SCHOOL DISTRICT, AS PROVIDED
BY RULES ADOPTED BY THE STATE BOARD OF EDUCATION.
SECTION 4. Safety clause. The general assembly hereby finds, determines, and declares that this act is necessary for the immediate preservation of the public peace, health, and safety.
