SENATE SPONSORSHIP Teck, House Committees Senate Committees Business Affairs and Labor A BILL FOR AN ACT Concerning the verification of an employee's identification. Bill Summary (Note: This summary applies to this bill as introduced and does not necessarily reflect any amendments that may be subsequently adopted.) Requires a person or entity who is hiring, recruiting, or referring an individual for employment in Colorado to require the individual to present a valid driver's license or identification card. Requires the person or entity to retain documentation of the driver's license or identification card and to submit the documentation to the division of labor (division) within the department of labor and employment upon request of the director of the division (director). Requires the director to levy a fine against a person or entity for the failure to require a driver's license or identification card, for the failure to retain and submit the required documentation, or for the submission of false or fraudulent documentation. Be it enacted by the General Assembly of the State of Colorado: SECTION 1. Part 1 of article 2 of title 8, Colorado Revised Statutes, is amended BY THE ADDITION OF A NEW SECTION to read: 8-2-122. Employer verification of employee's identification - driver's license - state-issued identification card - director - penalty. (1) In addition to the employment verification requirements specified in 8 U.S.C. sec. 1324a (b), a person or other entity hiring, recruiting, or referring an individual for employment in Colorado shall require the individual to present a valid driver's license or identification card issued by a state or outlying possession of the United States that contains a photograph and the name, date of birth, gender, height, eye color, and address of the individual. (2) (a) Each person or entity subject to the requirements of subsection (1) of this section shall retain documentation that the person or entity is in compliance with the requirements. (b) Upon request of the director of the division of labor in the department of labor and employment, a person or entity shall submit the required documentation to the division. Upon receipt of a valid complaint that an employer has not complied with the requirements of this section, the director shall request the submission of the documentation. The director shall levy a fine against an employer for the failure to require a driver's license or identification card, for the failure to retain and submit the required documentation, or for the submission of false or fraudulent documentation. The director, by rule, shall adopt a fine schedule for the purposes of this section. SECTION 2. Effective date - applicability. This act shall take effect January 1, 2007, and shall apply to persons or entities who hire, refer, or recruit an individual for employment on or after said date. SECTION 3. Safety clause. The general assembly hereby finds, determines, and declares that this act is necessary for the immediate preservation of the public peace, health, and safety.
