Bill Summary (Note: This summary applies to this bill as introduced and does not necessarily reflect any amendments that may be subsequently adopted.) Allows an individual who meets certain age requirements to renew his or her identification card by mail. Requires such a person renewing an identification card by mail to attest under penalty of law that he or she is lawfully present in the United States and is a resident of Colorado. Allows the department of revenue to promulgate rules. Extends the renewal period of identification cards for such persons to 10 years. Be it enacted by the General Assembly of the State of Colorado: SECTION 1. 42-2-304, Colorado Revised Statutes, is amended BY THE ADDITION OF A NEW SUBSECTION to read: 42-2-304. Validity of identification card - rules. (1.7) (a) If allowed under federal law, the department shall allow renewal of an identification card issued under section 42-2-302 by mail subject to the following requirements: (I) Renewal by mail shall be available to qualifying individuals as determined by the department of revenue including but not limited to persons with disabilities and individuals who are sixty-five years of age or older. (II) Renewal by mail shall only be available every other renewal period. (III) A person renewing by mail shall attest under penalty of perjury that he or she is lawfully present in the United States. (IV) A person renewing by mail shall attest under penalty of perjury that he or she is a resident of the state of Colorado. (b) Every applicant for renewal of an identification card by mail shall submit the required fee or surcharge, if any. (c) The department may promulgate rules necessary for the implementation of this subsection (1.7). SECTION 2. 42-2-304 (2), Colorado Revised Statutes, is amended BY THE ADDITION OF A NEW PARAGRAPH to read: 42-2-304. Validity of identification card. (2) (c) An identification card issued to an individual sixty-five years of age or older expires on the birthday of the registrant in the fifth year after issuance of the identification card. SECTION 3. Effective date. This act shall take effect July 1, 2006. SECTION 4. Safety clause. The general assembly hereby finds, determines, and declares that this act is necessary for the immediate preservation of the public peace, health, and safety.
