Bill Summary (Note: This summary applies to this bill as introduced and does not necessarily reflect any amendments that may be subsequently adopted.) Amends the 1905 irrigation district law by:  Increasing compensation paid to members of the district board of directors from $25 per day to up to $100 per day;  Increasing compensation paid to election judges from $20 per day to up to $100 per day; and  Increasing the value of district contracts that must be ratified by 1/3 of the electors from $50,000 to $250,000 and increasing the value of district contracts that must be ratified by the electors in the manner provided for the issue of bonds from $75,000 to $400,000. Be it enacted by the General Assembly of the State of Colorado: SECTION 1. 37-41-107 (5), Colorado Revised Statutes, is amended to read: 37-41-107. Office of board - elections. (5) Each judge of election shall receive as compensation for his services the sum of twenty up to one hundred dollars per day, to be paid by the district. SECTION 2. 37-41-108, Colorado Revised Statutes, is amended to read: 37-41-108. Directors - secretary - salaries. Each member of the board of directors may receive compensation at the rate of twenty-five up to one hundred dollars per day while attending meetings and shall be reimbursed for his or her actual and necessary expenses while engaged in official business. No director or officer named in this article shall be interested, directly or indirectly, in any manner, in any contract awarded or to be awarded by the board or in the profits to be derived therefrom, nor shall he or she receive any bonds, gratuity, or bribe. For any violation of this section, such officer commits a class 6 felony and shall be punished as provided in section 18-1.3-401, C.R.S. He or she shall also forfeit his or her office upon conviction. SECTION 3. 37-41-113 (4), Colorado Revised Statutes, is amended to read: 37-41-113. Board of directors - duties - contracts. (4) No contract involving a consideration exceeding two hundred fifty thousand dollars and not exceeding seventy-five four hundred thousand dollars shall be binding unless such contract shall be has been authorized and ratified in writing by not less than one-third of the legal electors of said district according to the number of votes cast at the last district election; nor shall any contract in excess of seventy-five four hundred thousand dollars be binding until such contract has been authorized and ratified at an election in the manner provided for the issue of bonds. SECTION 4. Effective date - applicability. (1) This act shall take effect July 1, 2006. (2) The provisions of this act shall apply to compensation paid and contracts entered into on or after the applicable effective date of this act. SECTION 5. Safety clause. The general assembly hereby finds, determines, and declares that this act is necessary for the immediate preservation of the public peace, health, and safety.
