Bill Summary (Note: This summary applies to this bill as introduced and does not necessarily reflect any amendments that may be subsequently adopted.) Changes the name of the division of prevention and intervention services for children and youth to the prevention services division. Be it enacted by the General Assembly of the State of Colorado: SECTION 1. 24-1-119 (5) (c) and (6.5), Colorado Revised Statutes, are amended to read: 24-1-119. Department of public health and environment - creation. (5) The department of public health and environment shall consist of the following divisions: (c) The division of prevention and intervention services for children and youth division, created in article 20.5 of title 25, C.R.S. (6.5) The division of prevention and intervention services for children and youth division shall include the office of homeless youth services, created by section 25-20.5-111, C.R.S. Said office and its powers, duties, and functions are transferred by a type 2 transfer to the department of public health and environment and allocated to the division of prevention and intervention services for children and youth division as a section thereof. SECTION 2. 25-20.5-102 (2), Colorado Revised Statutes, is amended to read: 25-20.5-102. Definitions. As used in this article, unless the context otherwise requires: (2) "Division" means the division of prevention and intervention services for children and youth division created in section 25-20.5-103. SECTION 3. 25-20.5-103 (1), Colorado Revised Statutes, is amended to read: 25-20.5-103. Prevention services division - creation. (1) There is hereby created within the department of public health and environment a division of prevention and intervention services for children and youth division. The division shall be headed by the director of prevention and intervention services appointed by the executive director of the department of public health and environment in accordance with section 13 of article XII of the state constitution. SECTION 4. 26-18-102 (3.5), Colorado Revised Statutes, is amended to read: 26-18-102. Definitions. As used in this article, unless the context otherwise requires: (3.5) "Division" means the division of prevention and intervention services division in the department of public health and environment. SECTION 5. 26-18-104 (1) (a), Colorado Revised Statutes, is amended to read: 26-18-104. Program created. (1) (a) There is hereby established in the division of prevention and intervention services division in the department of public health and environment a family resource center program. The purposes of said program shall be to provide grants to community applicants for the creation of family resource centers or to provide grants to family resource centers for the continued operation of such centers through which services for vulnerable families, individuals, children, and youth who live in communities or in at-risk neighborhoods are accessible and coordinated through a single point of entry. SECTION 6. Effective date. (1) This act shall take effect at 12:01 a.m. on the day following the expiration of the ninety-day period after final adjournment of the general assembly that is allowed for submitting a referendum petition pursuant to article V, section 1 (3) of the state constitution (August 4, 2004, if adjournment sine die is on May 5, 2004); except that, if a referendum petition is filed against this act or an item, section, or part of this act within such period, then the act, item, section, or part, if approved by the people, shall take effect on the date of the official declaration of the vote thereon by proclamation of the governor. (2) Notwithstanding the provisions of subsection (1) of this section, the portion of section 1 of this act that amends section 24-1-119 (6.5), Colorado Revised Statutes, shall not take effect if House Bill 04-1107 is enacted at the Second Regular Session of the Sixty-fourth General Assembly and becomes law.
