Concerning the annual appropriation of money in the central fund for veterans centers to the state department of human services. Be it enacted by the General Assembly of the State of Colorado: SECTION 1. In Colorado Revised Statutes, 26-12-108, amend (1) (b) (I); and add (1) (b) (I.5) and (1) (d) as follows: 26-12-108. Payments for care - funds - annual report - collections for charges - central fund for veterans centers created - repeal. (1) (b) (I) The state department is authorized to expend moneys out of the central fund for the direct and indirect costs incurred by the state department for the operation and administration of the veterans centers and for capital construction in connection with such veterans centers. Such expenditures shall not require an appropriation by the general assembly but shall be limited to amounts in the central fund. This subparagraph (I) is repealed, effective July 1, 2017. (I.5) For the fiscal year beginning July 1, 2017, and for each fiscal year thereafter: (A) The money in the central fund is continuously appropriated to the state department for the direct costs of the operation and administration of the veterans centers and for capital construction in connection with the veterans centers; and (B) Subject to annual appropriation, the state department may expend money from the central fund for indirect costs of the operation and administration of the veterans centers; except that the amount expended for indirect costs shall not exceed five percent of the total expenditures from the fund for the fiscal year. (d) As part of the budget request that the state department submits to the joint budget committee in accordance with section 2-3-208 (2) (a), C.R.S., the state department shall provide a detailed report of the anticipated direct and indirect costs for the operation and administration of each veterans center for the upcoming fiscal year, including amounts for personal services, operating expenses, indirect costs, centrally appropriated costs, and FTE. SECTION 2. Act subject to petition - effective date. This act takes effect at 12:01 a.m. on the day following the expiration of the ninety-day period after final adjournment of the general assembly (August 10, 2016, if adjournment sine die is on May 11, 2016); except that, if a referendum petition is filed pursuant to section 1 (3) of article V of the state constitution against this act or an item, section, or part of this act within such period, then the act, item, section, or part will not take effect unless approved by the people at the general election to be held in November 2016 and, in such case, will take effect on the date of the official declaration of the vote thereon by the governor. ____________________________ ____________________________ Bill L.
