      Ulibarri, Cadman.
      
      
      Concerning the authority of the department of corrections to
           distribute medication.
      
      
      Be it enacted by the General Assembly of the State of Colorado:
      
           SECTION 1.  In Colorado Revised Statutes, 12-42.5-118, amend
      (15) (b) as follows:
      
           12-42.5-118.  Compounding - dispensing - sale of drugs and
      devices - rules. (15) (b)  The following may distribute compounded and
      prepackaged medications, without limitation, to pharmacies under common
      ownership of the entity:
      
           (I)  A prescription drug outlet owned and operated by a hospital that
      is accredited by the joint commission on accreditation of healthcare
      organizations or a successor organization; and
      
           (II)  A prescription drug outlet operated by a health maintenance
      organization, as defined in section 10-16-102, C.R.S.; and
      
           (III)  The Colorado department of corrections.
      
           SECTION 2.  Safety clause. The general assembly hereby finds,
      determines, and declares that this act is necessary for the immediate
      preservation of the public peace, health, and safety.
