The bill authorizes the department to purchase individual health insurance through the exchange for individuals who are eligible for medicaid but prefer private insurance. The bill directs the department of health care policy and financing to apply to the secretary of the federal department of health and human services for all waivers necessary to allow the state to use the subsidy available under the federal "Patient Protection and Affordable Care Act" to purchase a health benefit plan through the Colorado Health Benefit Exchange (exchange). The bill requires the board of the exchange to provide information to the public about the process of purchasing private insurance through the exchange for a person who is eligible for medicaid. Be it enacted by the General Assembly of the State of Colorado: SECTION 1. In Colorado Revised Statutes, 10-22-106, add (5) as follows: 10-22-106. Powers and duties of the board. (5) (a) The board shall provide information on the process for an individual who is eligible for the state medicaid program to purchase a health benefit plan from an insurer participating in the exchange. (b) The board shall prominently display the information required in paragraph (a) of this subsection (5) on all promotional materials created by the exchange. SECTION 2. Act subject to petition - effective date. This act takes effect at 12:01 a.m. on the day following the expiration of the ninety-day period after final adjournment of the general assembly (August 10, 2016, if adjournment sine die is on May 11, 2016); except that, if a referendum petition is filed pursuant to section 1 (3) of article V of the state constitution against this act or an item, section, or part of this act within such period, then the act, item, section, or part will not take effect unless approved by the people at the general election to be held in November 2016 and, in such case, will take effect on the date of the official declaration of the vote thereon by the governor.
