House Committees Senate Committees State, Veterans, & Military Affairs A BILL FOR AN ACT Concerning elimination of the exemption from bill limitations established by the joint rules of the Colorado general assembly for legislation recommended by certain committees that meet during the legislative interim. Bill Summary (Note: This summary applies to this bill as introduced and does not reflect any amendments that may be subsequently adopted. If this bill passes third reading in the house of introduction, a bill summary that applies to the reengrossed version of this bill will be available at http://www.leg.state.co.us/billsummaries.) Generally, each member of the general assembly may not introduce more than 5 bills during a regular session of the general assembly. An exception to this bill introduction limitation exists for bills that are: Recommended by committees that meet during the interim and are created by state statute, by resolution of the executive committee of the legislative council, or in accordance with the statute governing legislative interim committees; and Approved by the legislative council of the general assembly. The bill eliminates the exemption from the bill introduction limitation for bills recommended by the following committees and approved by legislative council: Legislative interim committees created by statute, or by resolution of the executive committee of the legislative council; The Colorado health insurance exchange oversight committee; The school safety and youth in crisis committee; The early childhood and school readiness legislative commission; The water resources review committee; and The transportation legislation review committee. As a result, approved bills recommended by these committees would no longer be exempt from any bill introduction limitation created by the joint legislative rules. Be it enacted by the General Assembly of the State of Colorado: SECTION 1. In Colorado Revised Statutes, 2-3-303.3, amend (1) introductory portion and (1) (f) (II) as follows: 2-3-303.3. Interim committees. (1) Commencing on and after June 5, 2013, a legislative member may not request interim committees may not be requested by a legislative member by bill or resolution. No later than a day certain of a regular legislative session as established in the joint rules of the senate and house of representatives, a legislative member may submit a request in writing to the legislative council created in section 2-3-301 (1) regarding an issue that he or she wishes to study during the next interim between sessions. At minimum, the request must specify: (f) (II) Any Interim committee bills are exempt from the five-bill limitation subject to the bill limitations specified in rule 24 of the joint rules of the senate and the house of representatives. SECTION 2. In Colorado Revised Statutes, 10-22-107, amend (5) as follows: 10-22-107. Colorado health insurance exchange oversight committee - creation - duties. (5) In any year, the committee may report up to eight bills or other measures to the legislative council created in section 2-3-301, C.R.S. These bills are exempt from subject to any applicable bill limit imposed on the individual committee members sponsoring such bills if the bills have been approved by the legislative council under joint rules of the senate and house of representatives. SECTION 3. In Colorado Revised Statutes, 22-15-101, amend (1) (b) as follows: 22-15-101. School safety and youth in crisis committee - created - membership - repeal. (1) (b) The committee may recommend legislative changes. that shall be treated as legislation recommended by an interim committee for purposes of any Recommended legislation is subject to the introduction deadlines or and bill limitations imposed by specified in the joint rules of the general assembly. SECTION 4. In Colorado Revised Statutes, 26-6.5-203, amend (2) (c) as follows: 26-6.5-203. Early childhood and school readiness legislative commission - creation - membership - duties - funding. (2) (c) The commission shall report to the legislative council by the date specified in Joint Rule 24 (b)(1)(D). The report may include recommendations for legislation, including but not limited to legislation continuing the commission and an explanation of the additional time and procedures that the commission may require to achieve the commission's study goals. Legislation that the commission recommends shall be treated as legislation recommended by an interim committee for the purposes of is subject to the introduction deadlines and bill limitations imposed by specified in the joint rules of the senate and house of representatives. SECTION 5. In Colorado Revised Statutes, 37-98-103, amend (1) as follows: 37-98-103. Annual recommendations - bill limitation - deadlines for introduction. (1) The committee may report no more than three bills or other measures to the legislative council created in section 2-3-301, C.R.S., unless a two-thirds majority of the members of the committee vote to report a greater number; except that the committee shall not report any bills to the legislative council in 2010. No bill shall be reported The committee shall not report a bill to the legislative council unless a two-thirds majority of the appointed members of the committee vote to report such bill to the legislative council. Such greater number shall must not exceed one bill or other measure per member. These bills shall be exempt from any are subject to the applicable bill limit imposed on the individual committee members sponsoring such bills if the legislative council has approved the bills have been approved by the legislative council no later than October 15 in even-numbered years and November 15 in odd-numbered years. SECTION 6. In Colorado Revised Statutes, 43-2-145, amend (1) (c) as follows: 43-2-145. Transportation legislation review - committee - repeal. (1) (c) The committee may also conduct a postoperation review of such projects to determine whether the project was completed in the most cost-effective and efficient manner. The committee may require the department of transportation to prepare and adopt five-, ten-, and fifteen-year plans for the development of the state transportation system, and the committee shall monitor the progress of such plans. The committee may also require financial or performance audits to be conducted. Upon completion of its review of the transportation laws, the committee shall make recommendations to the governor and to the general assembly for such additional legislation as it deems necessary. The committee shall also develop and make recommendations concerning the financing of the state transportation system. Legislation recommended by the committee shall be treated as legislation recommended by an interim legislative committee for purposes of is subject to any introduction deadlines or bill limitations imposed by specified in the joint rules of the general assembly. SECTION 7. Act subject to petition - effective date. This act takes effect at 12:01 a.m. on the day following the expiration of the ninety-day period after final adjournment of the general assembly (August 10, 2016, if adjournment sine die is on May 11, 2016); except that, if a referendum petition is filed pursuant to section 1 (3) of article V of the state constitution against this act or an item, section, or part of this act within such period, then the act, item, section, or part will not take effect unless approved by the people at the general election to be held in November 2016 and, in such case, will take effect on the date of the official declaration of the vote thereon by the governor.
