Bill Summary (Note: This summary applies to this bill as introduced and does not reflect any amendments that may be subsequently adopted. Section 1 of the bill removes from the list of forms of documentation used for establishing identification for purposes of the "Uniform Election Code of 1992" (code): A copy of a current utility bill, bank statement, government check, paycheck, or other government document that shows the name and address of the elector; A valid medicare or medicaid card issued by the United States health care financing administration; A certified copy of a birth certificate for the elector issued in the United States; or Certified documentation of naturalization. Section 1 of the bill also allows a valid identification card issued by a nationally recognized tribal government to constitute identification for voting purposes if the identification contains a photograph of the eligible elector. Section 2 of the bill specifies that, in connection with any provision of the code requiring an elector to submit identification as a condition of casting a ballot, state law prohibits the department of revenue from charging certain applicants a fee for a state-issued identification card. Be it enacted by the General Assembly of the State of Colorado: SECTION 1. In Colorado Revised Statutes, 1-1-104, amend (19.5) (a) as follows: 1-1-104. Definitions. As used in this code, unless the context otherwise requires: (19.5) (a) "Identification" means: (I) A valid Colorado driver's license; except that a driver's license issued under part 5 of article 2 of title 42, C.R.S., is not a valid driver's license for purposes of this subsection (19.5); (II) A valid identification card issued by the department of revenue in accordance with the requirements of part 3 of article 2 of title 42, C.R.S.; (III) A valid United States passport; (IV) A valid employee identification card with a photograph of the eligible elector issued by any branch, department, agency, or entity of the United States government or of this state, or by any county, municipality, board, authority, or other political subdivision of this state; (V) A valid pilot's license issued by the federal aviation administration or other authorized agency of the United States that shows a photograph of the eligible elector; (VI) A valid United States military identification card with a photograph of the eligible elector; (VII) A copy of a current utility bill, bank statement, government check, paycheck, or other government document that shows the name and address of the elector; (VIII) A valid medicare or medicaid card issued by the United States health care financing administration; (IX) A certified copy of a birth certificate for the elector issued in the United States; (X) Certified documentation of naturalization; (XI) A valid student identification card with a photograph of the eligible elector issued by an institution of higher education in Colorado, as defined in section 23-3.1-102 (5), C.R.S.; (XII) A valid veteran identification card issued by the United States department of veterans affairs veterans health administration with a photograph of the eligible elector; or (XIII) A valid identification card issued by a federally recognized tribal government certifying tribal membership that shows a photograph of the eligible elector. SECTION 2. In Colorado Revised Statutes, add 1-7-118 as follows: 1-7-118. State-issued identification card provided free of charge. In connection with any provision of this code requiring an elector to submit identification as a condition of casting a ballot, section 42-2-306 (1) (a) (III.5), C.R.S., prohibits the department of revenue from charging certain applicants a fee for a state-issued identification card. SECTION 3. Appropriation. For the 2016-17 state fiscal year, $28,355 is appropriated to the department of state for use by the elections division. This appropriation is from the department of state cash fund created in section 24-21-104 (3) (b), C.R.S. To implement this act, the division may use this appropriation for operating expenses. SECTION 4. Act subject to petition - effective date - applicability. (1) This act takes effect at 12:01 a.m. on the day following the expiration of the ninety-day period after final adjournment of the general assembly (August 10, 2016, if adjournment sine die is on May 11, 2016); except that, if a referendum petition is filed pursuant to section 1 (3) of article V of the state constitution against this act or an item, section, or part of this act within such period, then the act, item, section, or part will not take effect unless approved by the people at the general election to be held in November 2016 and, in such case, will take effect on the date of the official declaration of the vote thereon by the governor. (2) This act applies to elections conducted on or after the applicable effective date of this act.
