Under current law, it is unlawful to transfer fetal tissue from an induced termination of pregnancy for valuable consideration to an institution that conducts fetal tissue research. The department of public health and environment and state registrar are tasked with enforcement of the prohibition. The bill gives the attorney general the authority to investigation violations and punish any violation. Be it enacted by the General Assembly of the State of Colorado: SECTION 1. In Colorado Revised Statutes, 25-2-111.5, amend (3) and (4) as follows: 25-2-111.5. Transfer of fetal tissue from induced termination of pregnancy - legislative declaration. (3) The attorney general shall investigate any alleged violations of subsection (2) of this section. Any physician or institution that violates subsection (2) of this section shall be fined by the state registrar attorney general not more than ten thousand dollars, depending upon the severity of the violation. (4) The department of public health and environment attorney general may promulgate rules related to enforcement activities necessary to implement subsections (2) and (3) of this section. SECTION 2. Safety clause. The general assembly hereby finds, determines, and declares that this act is necessary for the immediate preservation of the public peace, health, and safety.
