The bill clarifies that the people have the right to hunt, fish, and harvest wildlife and also establishes public hunting and fishing as the primary means to manage wildlife in the state of Colorado. Be it enacted by the General Assembly of the State of Colorado: SECTION 1. In Colorado Revised Statutes, 33-1-101, amend (4); and add (1.5) as follows: 33-1-101. Legislative declaration. (1.5) In order to preserve Colorado's hunting and fishing heritage, the people will always have the right to hunt, fish, and harvest wildlife. This right does not allow trespassing on private property; affect water rights; prevent the parks and wildlife commission, or a hearing officer with authority delegated by the parks and wildlife commission, from suspending or revoking an individual's hunting, fishing, or game-harvesting license; prevent the parks and wildlife commission from regulating the taking, possession, or use of wildlife in Colorado; or diminish other private rights. (4) The In order to preserve the heritage, traditions, and culture of wildlife conservation, the state shall utilize use public hunting, trapping, and fishing as the primary methods of effecting necessary wildlife harvests controlling and managing wildlife. SECTION 2. Act subject to petition - effective date. This act takes effect at 12:01 a.m. on the day following the expiration of the ninety-day period after final adjournment of the general assembly (August 10, 2016, if adjournment sine die is on May 11, 2016); except that, if a referendum petition is filed pursuant to section 1 (3) of article V of the state constitution against this act or an item, section, or part of this act within such period, then the act, item, section, or part will not take effect unless approved by the people at the general election to be held in November 2016 and, in such case, will take effect on the date of the official declaration of the vote thereon by the governor.
