Concerning the establishment of a future sunset review of the functions delegated to the director of the division of professions and occupations under the "Michael Skolnik Medical Transparency Act of 2010" to implement the recommendation of the department of regulatory agencies as contained in its 2015 sunset report pertaining to the division of professions and occupations. Be it enacted by the General Assembly of the State of Colorado: SECTION 1. In Colorado Revised Statutes, 24-34-110, add (12) as follows: 24-34-110. Medical transparency act of 2010 - disclosure of information about health care licensees - fines - rules - short title - legislative declaration - repeal. (12) This section is repealed, effective September 1, 2021. Prior to the repeal, the department of regulatory agencies shall review the functions of the program under this section as provided in section 24-34-104. SECTION 2. In Colorado Revised Statutes, 24-34-104, add (52.5) (f) as follows: 24-34-104. General assembly review of regulatory agencies and functions for termination, continuation, or reestablishment. (52.5) The following agencies, functions, or both, terminate on September 1, 2021: (f) The administration of the "Michael Skolnik Medical Transparency Act of 2010" by the director of the division of professions and occupations in accordance with section 24-34-110. SECTION 3. Act subject to petition - effective date. This act takes effect at 12:01 a.m. on the day following the expiration of the ninety-day period after final adjournment of the general assembly (August 10, 2016, if adjournment sine die is on May 11, 2016); except that, if a referendum petition is filed pursuant to section 1 (3) of article V of the state constitution against this act or an item, section, or part of this act within such period, then the act, item, section, or part will not take effect unless approved by the people at the general election to be held in November 2016 and, in such case, will take effect on the date of the official declaration of the vote thereon by the governor. ________________________________________________________ Dickey Lee Hullinghorst Bill L.
