Bill Summary (Note: This summary applies to this bill as introduced and does not reflect any amendments that may be subsequently adopted. If this bill passes third reading in the house of introduction, a bill summary that applies to the reengrossed version of this bill will be available at http://www.leg.state.co.us/billsummaries.) The bill requires the state patrol, no later than July 1, 2016, to present a plan to the capital development committee indicating its progress on working with the office of the state architect, the office of state planning and budgeting, and the department of transportation to address the state patrol's capital construction needs in Pueblo, Colorado. The bill also requires the state patrol, no later than November 1, 2017, to present a program plan that identifies the capital needs and projected costs for a state patrol facility in Pueblo, Colorado. The bill specifies that the program plan must be for either a new building or for a plan that establishes a cost share with the department of transportation for the department of transportation's region 2 headquarters relocation. Be it enacted by the General Assembly of the State of Colorado: SECTION 1. Legislative declaration. (1) The general assembly hereby finds and declares that: (a) The state patrol's district two facility for southeast Colorado is currently located in Pueblo, Colorado, in a building that the state patrol leases from the department of transportation; (b) The department of transportation owns land in Pueblo that includes three buildings, one of which the state patrol partially leases for its district two facility, the others of which house the department of transportation's region two headquarters; (c) The department of transportation has identified that these three buildings have fire and life safety concerns, ventilation concerns, flood plain concerns, ADA deficiencies, and need costly capital improvement repairs including mechanical systems and replacement of windows that are past their useful life; (d) The department of transportation is planning to relocate its region two headquarters from its current site and plans to sell the entire location; (e) The building in which the state patrol is currently housed might be adequate in size to relocate the entirety of the state patrol into one building, but that would mean the state patrol would have to buy the building from the department of transportation; (f) It would not make sense for the state patrol to buy a building that has documented deficiencies; (g) There have been minimal communications between the department of transportation and the state patrol regarding the department's plan to relocate and no discussions about options the state patrol may have with respect to the location of its division; and (h) Complicating the issue is the fact that the state patrol relies on a communication tower that is also located on the property that the department of transportation is looking to sell. (2) The general assembly further declares that: (a) The presence of the state patrol in Pueblo is imperative to the community; and (b) It is important that the general assembly be involved in the process to ensure that the state patrol is supported while the department of transportation moves forward with its region two headquarters relocation. SECTION 2. In Colorado Revised Statutes, add 24-33.5-228 as follows: 24-33.5-228. State patrol - facility location in Pueblo. (1) No later than July 1, 2016, the state patrol shall present a plan to the capital development committee indicating its progress on working with the office of the state architect, the office of state planning and budgeting, and the department of transportation to address the state patrol's capital construction needs in Pueblo, Colorado. (2) No later than November 1, 2017, the state patrol shall present a program plan that identifies the capital needs and projected costs for a state patrol facility in Pueblo, Colorado. The program plan must be for either a new building or for a plan that establishes a cost share with the department of transportation for the department of transportation's region two headquarters relocation. SECTION 3. Safety clause. The general assembly hereby finds, determines, and declares that this act is necessary for the immediate preservation of the public peace, health, and safety.
