Concerning the administration of money that is required under existing law to be transferred from the high cost support mechanism to the broadband fund. Be it enacted by the General Assembly of the State of Colorado: SECTION 1. In Colorado Revised Statutes, 40-15-509.5, amend (4) (a) as follows: 40-15-509.5. Broadband service - report - broadband deployment board - broadband fund - creation - repeal. (4) (a) There is hereby created in the state treasury the broadband fund, referred to in this section as the "fund". The fund consists of all moneys money allocated from the HCSM to provide access to broadband services through broadband networks in unserved areas pursuant to section 40-15-208 (2) (a) (I) (B), which moneys money shall be transferred to the fund upon allocation between July 1 and August 31 of each year, and all moneys money that the general assembly may appropriate to the fund. The moneys money in the fund are allocated from the HCSM is continuously appropriated to the broadband deployment board, created in subsection (5) of this section, for the purposes set forth in this section. Any other money in the fund is subject to annual appropriation by the general assembly for the purposes set forth in this section. All interest earned from the investment of moneys money in the fund is credited to the fund. All moneys money not expended at the end of the fiscal year remain remains in the fund and do does not revert to the general fund or any other fund. SECTION 2. Act subject to petition - effective date. This act takes effect January 1, 2017; except that, if a referendum petition is filed pursuant to section 1 (3) of article V of the state constitution against this act or an item, section, or part of this act within the ninety-day period after final adjournment of the general assembly, then the act, item, section, or part will not take effect unless approved by the people at the general election to be held in November 2016 and, in such case, will take effect on January 1, 2017, or on the date of the official declaration of the vote thereon by the governor, whichever is later. ________________________________________________________ Dickey Lee Hullinghorst Bill L.
