The bill makes a one-time general fund transfer in the 2016-17 state fiscal year to the Colorado state fair authority cash fund for the purpose of renovating and enhancing the horse show arena area facilities used at the Colorado state fair. Be it enacted by the General Assembly of the State of Colorado: SECTION 1. Legislative declaration. (1) The general assembly hereby finds and declares that: (a) The Colorado state fair has a tremendous positive effect on the state's agriculture, the state's industry, Pueblo county, and the state as a whole. Every year the Colorado state fair hosts family activities, fun-filled events, concerts, rodeos, arts, industrial presentations, and agriculture presentations, which promote and encourage agriculture, mineral, and livestock growth across Colorado and draw thousands of people to the state and Pueblo county. (b) The Work Projects Administration constructed the Colorado state fair horse arena during the Great Depression. The horse arena is now in significant need of maintenance and repair. The horse arena hosts a number of horse shows including roping contests, multiple non-fair shows of quarter horses and paints, and is home to one of the largest 4-H horse shows in the country, and other non-fair 4-H horse shows. The horse arena serves as Colorado's largest outdoor venue for equestrian sports and represents Colorado's proud traditions. (c) The horse arena also serves as an integral part of emergency planning for the Colorado state fairgrounds, as it provides shelter to livestock and other animals in the event of an emergency. (d) It is important that the state, in conjunction with other contributing parties or through gifts, grants, or donations, continues to ensure the sustainability of the Colorado state fair in order to preserve and continue to showcase Colorado's agriculture. SECTION 2. In Colorado Revised Statutes, 35-65-107, add (5) as follows: 35-65-107. State fair fund - lease and use of facilities - repeal. (5) (a) For the 2016-17 state fiscal year, the state treasurer shall transfer fifty thousand dollars from the general fund to the Colorado state fair authority cash fund created in this section for the purpose of renovating and enhancing the horse show arena area facilities used at the Colorado state fair. (b) This subsection (5) is repealed, effective July 1, 2018. SECTION 3. In Colorado Revised Statutes, 39-28.8-501, add (7) as follows: 39-28.8-501. Marijuana tax cash fund - creation - distribution - repeal. (7) (a) Notwithstanding subsection (3) of this section, if at the end of the 2015-2016 fiscal year the amount of money in the fund exceeds eighty-four million nine hundred forty-nine thousand eight hundred fifty-nine dollars, the state treasurer shall transfer fifty thousand dollars to the Colorado state fair authority cash fund created in section 35-65-107, C.R.S., for the 2016-2017 fiscal year. (b) This subsection (7) is repealed, effective July 1, 2018. SECTION 4. Appropriation. (1) For the 2016-17 state fiscal year, $50,000 is appropriated to the department of agriculture for use by the Colorado state fair. This appropriation is from the Colorado state fair authority cash fund created in section 35-65-107 (1), C.R.S. To implement this act, the state fair may use this appropriation for state fair facilities maintenance. (2) If $50,000 is transferred from the marijuana tax cash fund to the Colorado state fair authority cash fund pursuant to section 39-28.8-501 (7) (a), C.R.S., then for the 2016-17 state fiscal year, $50,000 is appropriated to the department of agriculture for use by the Colorado state fair. This appropriation is from the Colorado state fair authority cash fund created in section 35-65-107 (1), C.R.S. To implement this act, the state fair may use this appropriation for state fair facility maintenance. SECTION 5. Safety clause. The general assembly hereby finds, determines, and declares that this act is necessary for the immediate preservation of the public peace, health, and safety.
