Bill Summary (Note: This summary applies to this bill as introduced and does not reflect any amendments that may be subsequently adopted. The bill requires an operator of an assisted living facility to ensure that the administrator of the facility completes 30 hours of continuing education every 2 years. The operator must maintain records on the premises of the facility as proof of the fulfillment of the educational requirements. The department of public health and environment is required to promulgate rules concerning the educational requirements. Be it enacted by the General Assembly of the State of Colorado: SECTION 1. In Colorado Revised Statutes, add 25-27-104.3 as follows: 25-27-104.3. Administrators - continuing education - rules. Based upon a determination by the department, in consultation with the advisory committee established pursuant to section 25-27-110, concerning the recommended number of continuing education hours and the recommended content of the education for administrators of assisted living facilities, on or before January 1, 2017, the department shall promulgate rules to establish the continuing education requirements, which must include at least one credit hour for ethics and at least one credit hour concerning employee management. The department shall report its progress concerning the establishment of continuing education requirements for administrators of assisted living facilities to a joint meeting of the public health care and human services committee of the senate and the health, insurance, and environment committee of the house of representatives, or their successor committees, during the departmental presentations pursuant to section 2-7-203, C.R.S., for the 2016 and 2017 legislative sessions. SECTION 2. Act subject to petition - effective date. This act takes effect at 12:01 a.m. on the day following the expiration of the ninety-day period after final adjournment of the general assembly (August 5, 2015, if adjournment sine die is on May 6, 2015); except that, if a referendum petition is filed pursuant to section 1 (3) of article V of the state constitution against this act or an item, section, or part of this act within such period, then the act, item, section, or part will not take effect unless approved by the people at the general election to be held in November 2016 and, in such case, will take effect on the date of the official declaration of the vote thereon by the governor.
