Bill Summary (Note: This summary applies to this bill as introduced and does not reflect any amendments that may be subsequently adopted. The bill directs the department of education (department) to contract with an entity to review the statutory and regulatory data reporting requirements and implementation of the department's data reporting system. The department must work with members of the education data advisory committee (EDAC) in selecting and working with the entity. The department must submit the final report to the EDAC, the state board of education, and the education committees of the general assembly by January 31, 2016, and must post the report on the department's web site. Under current law, the education data advisory committee (EDAC) within the department consists of at least 5 volunteer school districts, 2 volunteer boards of cooperative services, and a volunteer charter school. Under the bill, at least 2 of the volunteer school district members of the EDAC must be rural school districts that enroll fewer than 1,000 students. Be it enacted by the General Assembly of the State of Colorado: SECTION 1. In Colorado Revised Statutes, add 22-2-310 as follows: 22-2-310. Data reporting requirements - study - report - repeal. (1) The department shall contract with an entity to review the existing state statutory and regulatory data reporting requirements to determine whether there are data reporting requirements that should be repealed because they do not provide necessary data or because the burden on school districts, boards of cooperative services, and charter schools of complying with the requirements is outweighed by the value of the data reported. In addition to recommending requirements that can be eliminated, the contract entity at a minimum shall: (a) Recommend reports that may be submitted biennially or less often; (b) Review the implementation of the department's data reporting system; and (c) Recommend measures to lessen the difficulties and burdens of implementing the data reporting system for school districts. (2) The department shall work with representatives from the EDAC, at least two of whom are from small rural school districts, to: (a) Write a request for proposals for an entity to complete the review and recommendations described in subsection (1) of this section; (b) Review the proposals received and select an entity with which to contract; (c) Review progress reports received from the entity and provide input on the work; and (d) Review the final report. (3) The department shall submit the final report to the EDAC, the state board, and the education committees of the house of representatives and the senate, or any successor committees, not later than January 31, 2016. The department shall also make the final report available to the public through its web site. (4) This section is repealed, effective July 1, 2016. SECTION 2. In Colorado Revised Statutes, 22-2-303, add (6.5) as follows: 22-2-303. Definitions. As used in this part 3, unless the context otherwise requires: (6.5) "Small rural school district" means a school district that is rural, based on the geographic size of the school district and the distance of the school district from the nearest large, urbanized area, and enrolls fewer than one thousand students. SECTION 3. In Colorado Revised Statutes, 22-2-304, amend (1) as follows: 22-2-304. Education data advisory committee - creation - duties - repeal. (1) The state board shall designate at least five volunteer school districts and two volunteer boards of cooperative services and a volunteer charter school, that are representative of the state as to pupil size and population, to send representatives to form a voluntary committee, to be known as the education data advisory committee. At least two of the volunteer school districts must be small rural school districts. The EDAC shall work with the department to review school district data reporting requirements and make recommendations as provided in this section. SECTION 4. Safety clause. The general assembly hereby finds, determines, and declares that this act is necessary for the immediate preservation of the public peace, health, and safety.
