First Regular Session Seventieth General Assembly STATE OF COLORADO INTRODUCED LLS NO. 15-0593.01 Jane Ritter x4342 SENATE BILL 15-054 SENATE SPONSORSHIP Donovan, HOUSE SPONSORSHIP Moreno, Senate Committees House Committees State, Veterans, & Military Affairs A BILL FOR AN ACT Concerning providing a fifth day of free or reduced-cost lunches to students who participate in the federal school lunch program and who are enrolled in a four-day week school. Currently, students who receive a free or reduced-cost school lunch through the federal school lunch program and who also attend a school that operates on a 4-day week do not receive a fifth day of free or reduced-cost lunch. The bill requires school food authorities that operate on a 4-day school week schedule to provide those students with a box lunch for the day of the week that the school is closed. Be it enacted by the General Assembly of the State of Colorado: SECTION 1. In Colorado Revised Statutes, 22-82.9-103, add (1.3) as follows: 22-82.9-103. Definitions. As used in this article, unless the context otherwise requires: (1.3) "Four-day school" means a school food authority that operates on a four-day week for school instruction. SECTION 2. In Colorado Revised Statutes, 22-82.9-104, amend (1); and add (3.5) as follows: 22-82.9-104. Child nutrition school lunch protection program - creation - administration - objectives. (1) There is hereby created the child nutrition school lunch protection program to ensure that each student in a Colorado public school has access five days per week to a healthy lunch at school to help the student participate fully in the learning process. (3.5) A four-day school shall provide an additional box lunch on Thursday, if the school is closed on Friday, and on Friday, if the school is closed on Monday, to each student participating in the school lunch program who is enrolled in the four-day school to ensure the student has access to a healthy lunch five days a week. SECTION 3. Safety clause. The general assembly hereby finds, determines, and declares that this act is necessary for the immediate preservation of the public peace, health, and safety.
