Concerning the participation of people who are not state employees in the state employee assistance program established by the state personnel director. Be it enacted by the General Assembly of the State of Colorado: SECTION 1. In Colorado Revised Statutes, 24-50-604, amend (1) (k) (III) as follows: 24-50-604. Powers and duties of the director. (1) (k) (III) Dependents of a state employee are not eligible to participate be the sole and direct recipient of services in any employee assistance program established and operated pursuant to this paragraph (k); except that an employee assistance program may allow a dependent or any other person who is not a state employee to participate in an employee assistance program if such participation is necessary to provide effective counseling and assistance to a state employee. SECTION 2. Safety clause.
