R15-0007.01 Gregg Fraser x4325 HCR15-1002 HOUSE SPONSORSHIP Priola, Foote, Coram, Klingenschmitt, Navarro, Roupe, Singer, Thurlow, Wilson, Windholz, Becker J., Becker K., Brown, Lundeen, Mitsch Bush, Neville P., Saine SENATE SPONSORSHIP Sonnenberg, Balmer House Committees Senate Committees Business Affairs and Labor Finance Appropriations HOUSE CONCURRENT RESOLUTION 15-1002 Submitting to the registered electors of the state of Colorado an amendment to the Colorado constitution concerning the regular sessions of the Colorado general assembly, and, in connection therewith, delaying the starting date of the regular session each year by one week, reducing the maximum number of days the general assembly can meet from one hundred twenty days to one hundred six days, and requiring the general assembly to adjourn mid-session for sixteen days to allow legislators to travel to their respective home districts, meet with their constituents, and prepare to address the issues under consideration at the current legislative session. Resolution Summary (Note: This summary applies to this resolution as introduced and does not reflect any amendments that may be subsequently adopted. The Colorado constitution requires the general assembly to meet in regular session no later than the second Wednesday of January of each year and for no more than 120 days. The concurrent resolution moves the starting date from the second to the third Wednesday in January and reduces the maximum number of days in a session from 120 to 106. The concurrent resolution also requires the general assembly to adjourn mid-session for 16 days to allow legislators to travel to their respective home districts, meet with their constituents, and prepare to address the issues under consideration at the current legislative session. Be It Resolved by the House of Representatives of the Seventieth General Assembly of the State of Colorado, the Senate concurring herein: WHEREAS, This amendment shall be known and may be cited as the "Colorado Legislative Overview and Constituent Knowledge (CLOCK) Act". SECTION 1. At the election held on November 8, 2016, the secretary of state shall submit to the registered electors of the state the ballot title set forth in section 2 for the following amendment to the state constitution: In the constitution of the state of Colorado, amend section 7 of article V as follows: Section 7. General assembly - shall meet when - term of members - committees. The general assembly shall meet in regular session at 10 a.m. no later than the second third Wednesday of January of each year. The general assembly shall meet at other times when convened in special session by the governor pursuant to section 9 of article IV of this constitution or by written request by two-thirds of the members of each house to the presiding officer of each house to consider only those subjects specified in such request. The term of service of the members of the general assembly shall begin begins on the convening of the first regular session of the general assembly next after their election. The committees of the general assembly, unless otherwise provided by the general assembly, shall expire expires on the convening of the first regular session after a general election. Regular sessions of the general assembly shall not exceed one hundred twenty six calendar days. In the constitution of the state of Colorado, amend section 15 of article V as follows: Section 15. Adjournment for more than three days - adjournment to visit home districts. (1) Except as provided in subsection (2) of this section, neither house shall, without the consent of the other, adjourn for more than three days, nor to any other place than that in which the two houses shall be sitting. (2) No earlier than the thirtieth day and no later than the sixtieth day of each regular session, both houses of the general assembly shall adjourn for a period of sixteen consecutive days for the purpose of allowing members to travel to their respective districts, meet with their constituents, and prepare to address the issues under consideration at the current legislative session. SECTION 2. Each elector voting at the election may cast a vote either "Yes/For" or "No/Against" on the following ballot title: "Shall there be an amendment to the Colorado constitution concerning the regular sessions of the Colorado general assembly, and, in connection therewith, delaying the starting date of the regular session each year by one week, reducing the maximum number of days the general assembly can meet from one hundred twenty days to one hundred six days, and requiring the general assembly to adjourn mid-session for sixteen days to allow legislators to travel to their respective home districts, meet with their constituents, and prepare to address the issues under consideration at the current legislative session?" SECTION 3. Except as otherwise provided in section 1-40-123, Colorado Revised Statutes, if a majority of the electors voting on the ballot title vote "Yes/For", then the amendment will become part of the state constitution.
