The bill gives peace officer authority to criminal tax enforcement special agents and motor vehicle criminal investigators in the department of revenue. Be it enacted by the General Assembly of the State of Colorado: SECTION 1. In Colorado Revised Statutes, add 16-2.5-152 and 16-2.5-153 as follows: 16-2.5-152. Criminal tax enforcement special agent. A criminal tax enforcement special agent employed by the department of revenue is a peace officer while engaged in the performance of his or her duties and while acting under proper orders or regulations. His or her primary authority involves investigating violations of section 39-21-118, C.R.S., and also includes the enforcement of all laws of the state of Colorado. The criminal tax enforcement special agent may be certified by the P.O.S.T. board. 16-2.5-153. Motor vehicle criminal investigator. A motor vehicle criminal investigator employed by the motor vehicle investigation unit in the department of revenue is a peace officer while engaged in the performance of his or her duties. His or her primary authority includes the enforcement of all laws of the state of Colorado. The motor vehicle criminal investigator may be certified by the P.O.S.T. board. SECTION 2. Safety clause. The general assembly hereby finds, determines, and declares that this act is necessary for the immediate preservation of the public peace, health, and safety.
