HOUSE BILL 15-1083 BY REPRESENTATIVE(S) Primavera, Duran, Singer, Esgar, Fields, Ginal, Hamner, Lebsock, Lee, Melton, Pettersen, Rosenthal, Ryden, Salazar, Young, Hullinghorst, Kraft-Tharp, Mitsch Bush, Moreno; also SENATOR(S) Crowder, Kefalas, Newell. Concerning patient financial contributions for physical rehabilitation services, and, in connection therewith, making an appropriation. Be it enacted by the General Assembly of the State of Colorado: SECTION 1. In Colorado Revised Statutes, add 10-16-142 as follows: 10-16-142. Physical rehabilitation services - copayments and coinsurance - research. (1) The Colorado commission on affordable health care created in section 25-46-103, C.R.S., shall conduct a study concerning the costs, including patient cost-sharing for physical rehabilitation services. The study shall analyze costs to the health care system, including payers and individual patients, as well as whether patient cost-sharing creates barriers to the effective use of physical rehabilitation services. (2) On or before November 1, 2015, the commission shall report its findings to the health and human services committee of the senate and the public health care and human services committee and the health, insurance, and environment committee of the house of representatives. (3) For the purposes of this section, "physical rehabilitation services" means physical therapy, occupational therapy, or chiropractic services for the treatment of a person who has sustained an illness, medical condition, or injury, with the goal of returning the person to his or her prior skill and function level or maintaining the person's current skill and function level. SECTION 2. In Colorado Revised Statutes, 25-46-104, amend (2) (q); and add (2) (q.5) as follows: 25-46-104. Duties of commission - mission - staffing - report. (2) The commission has the following powers and duties: (q) Any other authority necessary to perform its administrative duties; and (q.5) To conduct a study pursuant to section 10-16-142, C.R.S.; and SECTION 3. In Colorado Revised Statutes, 25-46-105, amend (1) (b) as follows: 25-46-105. Colorado commission on affordable health care cash fund - creation - funding sources - use of fund. (1) (b) Moneys in the fund are continuously appropriated to the department of public health and environment for allocation to the commission for the purposes of this article. The state treasurer shall credit to the fund all interest and income derived from the investment and deposit of moneys in the fund. Any unexpended and unencumbered moneys remaining in the fund at the end of any fiscal year remain in the fund and must not be credited or transferred to the general fund or any other fund. SECTION 4. Appropriation. For the 2015-16 state fiscal year, $25,000 is appropriated to the Colorado commission on affordable health care cash fund created in section 25-46-105 (1) (a), C.R.S. This appropriation is from the general fund. The department of public health and environment is responsible for the accounting related to this appropriation. SECTION 5. Safety clause.
