The bill creates a general definition of the term "small business" for purposes of Colorado law to apply in situations where a more specific definition does not exist in the statutes. The definition of "small business" created by the bill would not apply to any situation involving a state program where it is necessary for a state entity to use a different definition of small business or to apply different standards to the criteria governing eligibility for assistance to businesses resulting from conditions on the use of public or private moneys. Be it enacted by the General Assembly of the State of Colorado: SECTION 1. In Colorado Revised Statutes, 2-4-401, add (13.8) as follows: 2-4-401. Definitions. The following definitions apply to every statute, unless the context otherwise requires: (13.8) "Small business" means, unless otherwise specifically provided, a business with fewer than fifty employees and five million dollars or less in annual gross revenue. This definition does not apply in any situation involving a state program where it is necessary for a state entity to use a different definition of "small business" or to apply different standards to the criteria governing eligibility for assistance to businesses resulting from conditions on the use of public or private moneys. SECTION 2. Act subject to petition - effective date. This act takes effect at 12:01 a.m. on the day following the expiration of the ninety-day period after final adjournment of the general assembly (August 5, 2015, if adjournment sine die is on May 6, 2015); except that, if a referendum petition is filed pursuant to section 1 (3) of article V of the state constitution against this act or an item, section, or part of this act within such period, then the act, item, section, or part will not take effect unless approved by the people at the general election to be held in November 2016 and, in such case, will take effect on the date of the official declaration of the vote thereon by the governor.
