Concerning a requirement that legislative service agencies review the fiscal impact of legislative measures considered by committees of the general assembly that meet during the interim. Be it enacted by the General Assembly of the State of Colorado: SECTION 1. Legislative declaration. (1) The general assembly hereby finds, determines, and declares that: (a) Fiscal notes are a critically important component of informed decision making by legislators because they allow legislators to understand the complete fiscal impact of potential legislation on all levels of government; (b) Understanding the fiscal impact a bill will have on state government, local government, or the state's economy is a vital piece of information in allowing legislators to make informed decisions on whether the bill should move forward; (c) Interim committees provide a helpful tool for legislators to better understand public policy dilemmas by allowing legislators the opportunity to study a given subject in greater depth than is typically possible during the legislative session; (d) Currently, the fiscal impact of legislative measures are not available for interim committee review at the time the measures are being considered; (e) Providing members of interim committees a fiscal note to accompany the legislative measures being considered would give the members a more thorough understanding of the public policy impacts of such legislation before, in many cases, recommending such legislation to the legislative council as an approved interim committee bill. (2) By enacting this legislation, the general assembly intends to provide legislators serving on interim committees more information as to the fiscal impacts of the legislative proposals by requiring a fiscal note to be prepared for each legislative measure considered by the interim committee. SECTION 2. In Colorado Revised Statutes, 2-2-322, add (4) as follows: 2-2-322. Fiscal notes. (4) In addition to any other requirement under this section or in the legislative rules for legislative service agency review of the fiscal impact of legislative measures, the general assembly shall also provide for legislative service agency review of the fiscal impact of legislative measures considered by committees of the general assembly meeting during the legislative interim. For each interim, the deadlines and guidelines adopted prior to each interim by the executive committee of the legislative council for requesting and finalizing interim committee bills must allow for sufficient time between the public release of the fiscal note for a particular measure by the staff of the legislative council and the final vote by the applicable legislative interim committee so that members of the committee are able to consider the fiscal note in voting on the measure. For each interim, the specific dates by which these requirements will be satisfied must be specified in the applicable set of deadlines and guidelines for that interim. Except as otherwise provided in this subsection (4), all other requirements governing legislative service agency review of the fiscal impact of legislative measures considered during regular legislative sessions that are specified in this section or in the legislative rules also govern the requirements of this subsection (4). SECTION 3. Safety clause.
