Bill Summary (Note: This summary applies to this bill as introduced and does not reflect any amendments that may be subsequently adopted. If this bill passes third reading in the house of introduction, a bill summary that applies to the reengrossed version of this bill will be available at http://www.leg.state.co.us/billsummaries.) The bill creates the statewide membership organization grant program (grant program) for statewide membership organizations (statewide organizations) that operate as umbrella administrative organizations for smaller youth services organizations (member organizations) throughout the state. Eligible member organizations must meet all existing criteria for a Tony Grampsas youth services program, as well as several additional criteria. The statewide organizations must be comprised of eligible member organizations that collectively serve children and youth, a minimum of 60% of whom qualify for free or reduced-cost lunch, and provide services to a minimum of 25 counties, 30% of which must be considered rural. The Tony Grampsas youth services board (board) shall review grant applications and award grants to eligible statewide organizations, based on board-determined guidelines and criteria. Grants awarded through the grant program may be of any size, and the board shall not place a cap on dollar amounts that may be awarded. The statewide membership organization grant fund is created. Be it enacted by the General Assembly of the State of Colorado: SECTION 1. In Colorado Revised Statutes, add 26-6.8-107 as follows: 26-6.8-107. Statewide membership organization grant program - criteria. (1) Definitions. As used in this section, unless the context otherwise requires: (a) "Eligible member organization" means an organization that provides services to children and youth, is a part of a statewide membership organization, and meets the eligibility criteria set forth in paragraph (b) of subsection (2) of this section. (b) "Fund" means the statewide membership organization grant fund created in subsection (4) of this section. (c) "Program" means the statewide membership organization grant program created in subsection (2) of this section. (d) "School lunch program" means the federal "National School Lunch Act" created in 42 U.S.C. sec. 1751 et seq. (e) "Statewide membership organization" means a youth service organization comprised of at least ten eligible member organizations throughout the state that meets the eligibility criteria set forth in paragraph (c) of subsection (2) of this section. (2) (a) Statewide membership organization grant program - creation. There is created in the Tony Grampsas youth services program the statewide membership organization grant program to provide grants to statewide membership organizations comprised of smaller eligible member organizations. (b) A youth organization that is part of a statewide membership organization must meet the following criteria to be an eligible member organization: (I) Meet existing eligibility criteria for youth services programs as described in sections 26-6.8-102 and 26-6.8-103; (II) Be in good standing with a national, congressionally chartered organization's standards and provide activities designed for educational and character-building purposes for children and youth; (III) Provide regular facility-based, after-school and summer programs with youth development services available at least fifteen hours per week during the school year and thirty hours per week during the summer; (IV) Offer regular homework assistance, tutoring, and academic enrichment activities led by paid professional staff and supplemented by volunteers; and (V) Provide a uniform overall program structure, as established by the statewide membership organization. (c) A statewide membership organization is eligible to receive a grant through the program if its eligible member organizations collectively: (I) Provide services in a minimum of twenty-five counties, with at least thirty percent of those counties deemed rural according to the state demographer; and (II) Serve children and youth, a minimum of sixty percent of whom qualify for free or reduced-cost lunch under the school lunch program. (3) Administration. (a) The state department shall administer the program. The board shall select the statewide membership organizations that will receive grants through the program and the amount of each grant. In addition, the state department shall monitor the effectiveness of the statewide membership organizations that receive grant moneys. To be eligible for a grant through the program, a statewide membership organization shall apply to the board in accordance with the timelines and guidelines adopted by the board pursuant to section 26-6.8-103. (b) The board shall not place a cap on the dollar amount for grants awarded to statewide membership organizations through the program. (c) All existing provisions for Tony Grampsas youth services programs established in sections 26-6.8-102 and 26-6.8-103 apply to the program. (4) Statewide membership organization grant fund - creation. There is created in the state treasury the statewide membership organization grant fund consisting of moneys that the general assembly may appropriate to the fund. The moneys in the fund are subject to annual appropriation by the general assembly to the state department for the purpose of providing grants to statewide membership organizations as provided in this section and the direct and indirect costs associated with the implementation of this section. Any moneys in the fund not expended for the purpose of this section may be invested by the state treasurer as provided by law. The state treasurer shall credit all interest and income derived from the investment and deposit of moneys in the fund to the fund. Any unexpended and unencumbered moneys remaining in the fund at the end of a fiscal year must remain in the fund and shall not be credited or transferred to the general fund or another fund. SECTION 2. In Colorado Revised Statutes, 26-6.8-103, amend (2) (b) introductory portion, (2) (c), (3), (4), and (5) as follows: 26-6.8-103. Tony Grampsas youth services board - members - duties. (2) (b) In addition to the guidelines developed pursuant to paragraph (a) of this subsection (2), the board shall develop criteria for awarding grants under the Tony Grampsas youth services program and the statewide membership organization grant program, including but not limited to the following requirements: (c) In addition to the guidelines and criteria developed pursuant to paragraphs (a) and (b) of this subsection (2), the board shall develop result-oriented criteria for measuring the effectiveness of programs that receive grants under the Tony Grampsas youth services program and the statewide membership organization grant program as deemed appropriate to the nature of each program including, but not limited to, requiring grantees to evaluate the impact of the services provided by the program. Any criteria developed pursuant to this paragraph (c) for measuring the effectiveness of student dropout prevention and intervention programs established pursuant to section 26-6.8-105 shall must include the implementation of a method by which to track the students served by the program to evaluate the impact of the services provided, which tracking shall continue, if possible, for at least two years or through graduation from a secondary school, whichever occurs first. (3) In addition to the guidelines and criteria developed pursuant to subsection (2) of this section, the board shall establish timelines for submission and review of applications for grants through the Tony Grampsas youth services program and the statewide membership organization grant program. The board shall also adopt timelines for submission to the governor of the list of entities chosen to receive grants. If the governor disapproves the list, the board may submit a replacement list within thirty days after such disapproval. (4) The board shall review all applications received pursuant to section 26-6.8-102 for grants from the Tony Grampsas youth services program and section 26-6.8-107 for grants from the statewide membership organization grant program and choose those entities that shall will receive grants through the Tony Grampsas youth services program and the amount of each grant. (5) In addition to the duties relating specifically to the Tony Grampsas youth services program specified in this section, the board shall operate the prevention, intervention, and treatment programs specified in this article, including the statewide membership organization grant program and such other prevention, intervention, and treatment programs as may be assigned to the board by executive order to be funded solely by federal funds. SECTION 3. Act subject to petition - effective date. This act takes effect at 12:01 a.m. on the day following the expiration of the ninety-day period after final adjournment of the general assembly (August 5, 2015, if adjournment sine die is on May 6, 2015); except that, if a referendum petition is filed pursuant to section 1 (3) of article V of the state constitution against this act or an item, section, or part of this act within such period, then the act, item, section, or part will not take effect unless approved by the people at the general election to be held in November 2016 and, in such case, will take effect on the date of the official declaration of the vote thereon by the governor.
