Concerning a prohibition on the transfer of state-operated beds under the waiver for home- and community-based services for individuals with intellectual and developmental disabilities. Be it enacted by the General Assembly of the State of Colorado: SECTION 1. In Colorado Revised Statutes, add 27-10.5-311 as follows: 27-10.5-311. Regional centers - waiver beds - prohibition on closure or sale - repeal. (1) Prior to May 16, 2016, the department shall not close or sell any state-operated beds licensed pursuant to the home- and community-based services for persons with developmental disabilities waiver and shall maintain an adequate number of beds at the regional centers for individuals who transitioned to the community within the preceding six months, but who have been identified by a community-centered board and the individual's legal guardian as having had an unsuccessful transition. The department shall permit the individual to return to a state-operated regional center bed pursuant to section 27-10.5-110 and applicable federal law. (2) This section is repealed, effective July 1, 2016. SECTION 2. Act subject to petition - effective date. This act takes effect at 12:01 a.m. on the day following the expiration of the ninety-day period after final adjournment of the general assembly (August 5, 2015, if adjournment sine die is on May 6, 2015); except that, if a referendum petition is filed pursuant to section 1 (3) of article V of the state constitution against this act or an item, section, or part of this act within such period, then the act, item, section, or part will not take effect unless approved by the people at the general election to be held in November 2016 and, in such case, will take effect on the date of the official declaration of the vote thereon by the governor. ____________________________ ____________________________ Bill L.
