First Regular Session Seventieth General Assembly STATE OF COLORADO INTRODUCED LLS NO. 15-0154.01 Jery Payne x2157 SENATE BILL 15-066 SENATE SPONSORSHIP Ulibarri, HOUSE SPONSORSHIP (None), Senate Committees House Committees State, Veterans, & Military Affairs A BILL FOR AN ACT Concerning an expansion of the types of government documents that are legally sufficient as a basis for the department of revenue to issue identification documents to persons who are not permanent lawful residents. Currently, a person who is not lawfully present in the United States must produce a taxpayer identification number, among other documents, in order to obtain a driver's license or identification card. Section 1 of the bill expands this requirement so that a person may produce a social security number instead. Currently, the applicant must also document that the applicant has been a resident in Colorado for the last 24 months. Section 1 clarifies that the documentation need not account for every day of those 24 months. Currently, a person who is temporarily lawfully present may obtain a driver's license. Section 2 clarifies that an international student need not surrender a driver's license issued in a foreign jurisdiction. Be it enacted by the General Assembly of the State of Colorado: SECTION 1. In Colorado Revised Statutes, 42-2-505, amend (1) (b) (II) and (1) (c) as follows: 42-2-505. Identification documents - individuals not lawfully present. (1) Documents issued. An individual who is not lawfully present may apply for an identification document in accordance with this part 5. The department shall issue an identification document to an applicant who: (b) (II) Signs an affidavit that the applicant has continuously been a resident in Colorado for the immediately preceding twenty-four months and presents evidence of residence in Colorado for the immediately preceding twenty-four months that: (A) Conforms to the standards of Pub.L. 109-13, Division B, Title II, sec. 201 et seq. or any rules promulgated under Pub.L. 109-13, Division B, Title II, sec. 201 et seq.; and (B) Accounts for as much of the period as reasonably possible; except that every day or month of the period need not be accounted for through direct evidence; and (c) Documents one of the following: (I) An individual taxpayer identification number issued by an agency of the United States internal revenue service government; or (II) A social security number issued by an agency of the United States government; and SECTION 2. In Colorado Revised Statutes, 42-2-506, add (2) as follows: 42-2-506. Identification documents - individuals temporarily lawfully present. (2) To obtain an identification document, an international student need not surrender a driver's license issued by the government of a foreign country. SECTION 3. Act subject to petition - effective date. This act takes effect at 12:01 a.m. on the day following the expiration of the ninety-day period after final adjournment of the general assembly (August 5, 2015, if adjournment sine die is on May 6, 2015); except that, if a referendum petition is filed pursuant to section 1 (3) of article V of the state constitution against this act or an item, section, or part of this act within such period, then the act, item, section, or part will not take effect unless approved by the people at the general election to be held in November 2016 and, in such case, will take effect on the date of the official declaration of the vote thereon by the governor.
