NOTE: The governor signed this measure on 4/3/2015. SENATE BILL 15-103 BY SENATOR(S) Lundberg, Aguilar, Newell; also REPRESENTATIVE(S) Becker K., Fields, Tyler. Concerning continuation of the compliance advisory panel, and, in connection therewith, implementing the recommendations of the department of regulatory agencies as contained in the 2014 sunset report. Be it enacted by the General Assembly of the State of Colorado: SECTION 1. In Colorado Revised Statutes, 2-3-1203, add (3) (mm) as follows: 2-3-1203. Sunset review of advisory committees. (3) The following dates are the dates on which the statutory authorization for the designated advisory committees is scheduled for repeal: (mm) September 1, 2026: (I) The compliance advisory panel to the air pollution control division in the department of public health and environment created in section 25-7-109.2, C.R.S. SECTION 2. In Colorado Revised Statutes, 25-7-109.2 amend (2) (d), (4), and (6) as follows: 25-7-109.2. Small business stationary source technical and environmental compliance assistance program - repeal. (2) There is hereby created a compliance advisory panel, which shall: (d) Oversee Advise the small business stationary source technical and environmental compliance assistance program, which shall serve as the secretariat for the development and dissemination of such reports and advisory opinions. (4) The terms of those members of the panel initially appointed by the governor, the speaker of the house of representatives, and the minority leader of the house of representatives shall expire on January 31, 1994. The terms of those members initially appointed by the president of the senate, the minority leader of the senate, and the executive director of the department of public health and environment shall expire on January 31, 1995. Thereafter, members of the panel shall serve for terms of two three years, such terms to commence on February 1 of the year of appointment. Vacancies occurring during the term of office of any member of the panel shall be filled for the unexpired portion of the regular term in the same manner as for the original appointment. (6) The general assembly finds, determines, and declares that this section is enacted for purposes of compliance with the provisions of section 507 of the federal act, 42 U.S.C. sec. 7661f. Subsections (2), (3), and (4) of this section and this subsection (6) are repealed, effective July 1, 2015 September 1, 2026. Prior to said repeal, the compliance advisory panel shall be reviewed by a legislative committee of reference, designated pursuant to section 2-3-1201, C.R.S., to conduct the review pursuant to section 24-34-104 2-3-1203, C.R.S. SECTION 3. In Colorado Revised Statutes, 24-34-104, repeal (46) (d) as follows: 24-34-104. General assembly review of regulatory agencies and functions for termination, continuation, or reestablishment. (46) The following agencies, functions, or both shall terminate on July 1, 2015: (d) The compliance advisory panel to the air pollution control division in the department of public health and environment created in section 25-7-109.2, C.R.S.; SECTION 4. Effective date. This act takes effect July 1, 2015. SECTION 5. Safety clause.
