SENATE BILL 15-008 BY SENATOR(S) Roberts, Hodge, Jones, Carroll, Crowder, Donovan, Garcia, Heath, Johnston, Kefalas, Merrifield, Newell, Steadman, Todd; also REPRESENTATIVE(S) Vigil, Coram, Mitsch Bush, Becker K., Buckner, Duran, Esgar, Fields, Ginal, Hamner, Kraft-Tharp, Lebsock, Moreno, Pettersen, Rosenthal, Ryden, Williams, Winter, Young, Hullinghorst. Concerning the promotion of water conservation in the land use planning process, and, in connection therewith, making an appropriation. Be it enacted by the General Assembly of the State of Colorado: SECTION 1. In Colorado Revised Statutes, 37-60-126, amend (4) introductory portion, (4) (d), and (4) (e); and add (4) (f) as follows: 37-60-126. Water conservation and drought mitigation planning - programs - relationship to state assistance for water facilities - guidelines - water efficiency grant program - repeal. (4) A plan developed by a covered entity pursuant to subsection (2) of this section shall must, at a minimum, include a full evaluation of the following plan elements: (d) The time period, not to exceed seven years, after which the covered entity will review and update its adopted plan; and (e) Either as a percentage or in acre-foot increments, an estimate of the amount of water that has been saved through a previously implemented conservation plan and an estimate of the amount of water that will be saved through conservation when the plan is implemented; and (f) (I) Best management practices for water demand management, water efficiency, and water conservation that may be implemented through land use planning efforts. (II) In order to assist covered entities in meeting the requirements of subparagraph (I) of this paragraph (f), the board, in consultation with the division of local government in the department of local affairs, shall: (A) Develop training programs, including introductory programs, refresher programs, and advanced programs, for local government water use, water demand, water consumption, and land use planners regarding best management practices for water demand management, water efficiency, and water conservation; (B) Provide the training, on a recurring basis, free of charge to local water use, water demand, and land use planners; and (C) Make recommendations regarding how to better integrate water demand management and conservation planning into land use planning, including, as appropriate, legislative, regulatory, and guidance or policy recommendations. SECTION 2. Appropriation. For the 2015-16 state fiscal year, $50,000 is appropriated to the department of natural resources for use by the Colorado water conservation board. This appropriation is from the Colorado water conservation board construction fund created in section 37-60-121 (1) (a), C.R.S. To implement this act, the Colorado water conservation board may use this appropriation for the water conservation program. SECTION 3. Act subject to petition - effective date - applicability. (1) This act takes effect at 12:01 a.m. on the day following the expiration of the ninety-day period after final adjournment of the general assembly (August 5, 2015, if adjournment sine die is on May 6, 2015); except that, if a referendum petition is filed pursuant to section 1 (3) of article V of the state constitution against this act or an item, section, or part of this act within such period, then the act, item, section, or part will not take effect unless approved by the people at the general election to be held in November 2016 and, in such case, will take effect on the date of the official declaration of the vote thereon by the governor.
