First Regular Session Seventieth General Assembly STATE OF COLORADO INTRODUCED LLS NO. 15-1108.01 Brita Darling x2241 SENATE BILL 15-280 SENATE SPONSORSHIP Scheffel and Carroll, Crowder, Kerr, Sonnenberg, Steadman HOUSE SPONSORSHIP Wilson and Fields, Senate Committees House Committees Education A BILL FOR AN ACT Concerning ensuring that a school district does not lose total program funding as a result of the inclusion of multi-district on-line pupils in the calculation of the school district's size factor. The bill excludes multi-district on-line pupils from the calculation of the size factor if including those students results in a decrease in total program funding for the district from the funding that the district would have received without including the multi-district on-line pupils in the calculation of the size factor. Be it enacted by the General Assembly of the State of Colorado: SECTION 1. In Colorado Revised Statutes, 22-54-104, add (5) (b) (V) as follows: 22-54-104. District total program - definitions. (5) (b) (V) Notwithstanding any provision of this paragraph (b) to the contrary, for the 2015-16 budget year and each budget year thereafter, if including a district's on-line pupil enrollment in the district's funded pupil count for purposes of calculating the district's size factor results in less total program funding for the district than if the on-line pupil enrollment were excluded, then the funded pupil count used to calculate the district's size factor shall not include the district's on-line pupil enrollment for the applicable budget year. SECTION 2. Safety clause. The general assembly hereby finds, determines, and declares that this act is necessary for the immediate preservation of the public peace, health, and safety.
