The bill creates the off-highway task force to study the issue of road use by off-highway vehicles. The task force represents: The agriculture, livestock, and natural resources committee of the house of representatives; The senate; The Colorado state patrol; 3 county commissioners nominated by an association of counties; The division of parks and wildlife; The environmental community; The finance committee of the house of representatives; An association of hunting outfitters; An active member of an off-road recreation club or association; Powersports dealers; and Colorado sheriffs. The task force will make recommendations to the general assembly, including any recommended legislation, by December 1, 2015. Be it enacted by the General Assembly of the State of Colorado: SECTION 1. In Colorado Revised Statutes, add part 19 to article 2 of title 2 as follows: PART 19 OFF-HIGHWAY VEHICLE TASK FORCE 2-2-1901. Definitions. As used in this part 19, unless the context otherwise requires: (1) "Off-highway vehicles" means vehicles designed primarily for off-road use, including all-terrain vehicles and side-by-side vehicles. (2) "Road" means a publicly maintained right-of-way used primarily by motor vehicles and not specifically designated for off-highway use. (3) "Task force" means the off-highway vehicle task force created in section 2-2-1902. 2-2-1902. Task force created - off-highway vehicles. (1) The off-highway vehicle task force is hereby created to study the issue of driving off-highway vehicles on roads. The task force shall consider safety and access issues and any regulation necessary to operate off-highway vehicles on roads. (2) No later than July 1, 2015, the speaker and minority leader of the house of representatives and the president and the minority leader of the senate shall appoint the members of the task force. The appointing authorities shall ensure that the task force consists of thirteen members who represent the following: (a) The agriculture, livestock, and natural resources committee of the house of representatives; (b) The senate; (c) The Colorado state patrol; (d) Three County commissioners who are nominated by an association of Colorado counties; (e) The division of parks and wildlife; (f) The environmental community; (g) The finance committee of the house of representatives; (h) An association of hunting outfitters; (i) An active member of an off-road recreation club or association; (j) Powersports dealers or a powersports dealer association; and (k) Colorado sheriffs; (3) If a vacancy occurs on the task force, the original appointing authority shall appoint a person who meets the requirements of the vacant position to fill the vacancy as soon as possible after the vacancy occurs. 2-2-1903. Meetings. The speaker of the house of representatives shall convene the first meeting of the task force no later than October 15, 2015. At the first meeting, the task force members shall select from among the membership a person to serve as chair of the task force. The task force shall meet upon the call of the chair as often as necessary to complete the duties specified in this part 19, but is urged to meet no more often than necessary and no more than twice if possible. The task force may meet within the committee hearing rooms of the state capitol, subject to availability. 2-2-1904. Report. The task force shall consider the issues concerning the need to drive an off-highway vehicle on roadways and make recommendations, including any recommended legislation, to the general assembly by December 1, 2015. 2-2-1905. Repeal of part. This part 19 is repealed, effective July 1, 2017. SECTION 2. Safety clause. The general assembly hereby finds, determines, and declares that this act is necessary for the immediate preservation of the public peace, health, and safety.
