Under current law, if the owner of a motor vehicle fails to register the vehicle when required, the owner must, upon registering the vehicle and subject to a $100 cap, pay a late fee of $25 for each month or portion of a month for which the registration was late. The bill repeals the late fee. Be it enacted by the General Assembly of the State of Colorado: SECTION 1. In Colorado Revised Statutes, repeal 42-3-112. SECTION 2. In Colorado Revised Statutes, 43-4-804, amend (1) (e) as follows: 43-4-804. Highway safety projects - surcharges and fees - crediting of moneys to highway users tax fund - definition - repeal. (1) On and after July 1, 2009, the following surcharges, fees, and fines shall be collected and credited to the highway users tax fund created in section 43-4-201 (1) (a) and allocated to the state highway fund, counties, and municipalities as specified in section 43-4-205 (6.3): (e) (I) Late registration fees required to be credited to the highway users tax fund pursuant to section 42-3-112 (2), C.R.S., as that section existed before January 1, 2016. (II) This paragraph (e) is repealed, effective January 1, 2017. SECTION 3. Act subject to petition - effective date - applicability. (1) This act takes effect January 1, 2016; except that, if a referendum petition is filed pursuant to section 1 (3) of article V of the state constitution against this act or an item, section, or part of this act within the ninety-day period after final adjournment of the general assembly, then the act, item, section, or part will not take effect unless approved by the people at the general election to be held in November 2016 and, in such case, will take effect on the date of the official declaration of the vote thereon by the governor. (2) This act applies to late vehicle fees which, but for this act, would accrue on or after the applicable effective date of this act.
