Capital Development Committee. The bill creates the regional center depreciation and controlled maintenance account in the capital construction fund and requires the state controller to annually transfer to the account all moneys received by the department of health care policy and financing for depreciation of the state's regional centers. The bill specifies that the moneys in the account are subject to appropriation and may only be used to fund controlled maintenance of the state's regional centers only after the department of human services submits a request for moneys from the fund to the capital development committee. Be it enacted by the General Assembly of the State of Colorado: SECTION 1. In Colorado Revised Statutes, 24-75-302, add (3.7) as follows: 24-75-302. Capital construction fund - capital assessment fees - calculation - repeal. (3.7) There is hereby created an account within the capital construction fund, established pursuant to subsection (1) of this section, to be known as the regional center depreciation and controlled maintenance account. For the 2014-15 fiscal year, and each fiscal year thereafter, the state controller shall annually transfer to the account all moneys received by the department of health care policy and financing for depreciation of the state's regional centers. The moneys in the account are subject to appropriation and may only be used to fund controlled maintenance of the state's regional centers. The department of human services shall submit requests for moneys from the fund to the capital development committee and only upon approval by the capital development committee may an appropriation be authorized in a bill enacted by the general assembly, the annual general appropriation act, or a supplemental appropriation act. All moneys unexpended or unencumbered in any fiscal year must remain in the account. SECTION 2. Safety clause. The general assembly hereby finds, determines, and declares that this act is necessary for the immediate preservation of the public peace, health, and safety.
