SENATE BILL 15-020 BY SENATOR(S) Newell, Aguilar, Carroll, Donovan, Heath, Hodge, Johnston, Jones, Kefalas, Kerr, Merrifield, Steadman, Todd; also REPRESENTATIVE(S) McCann, Fields, Hamner, Kraft-Tharp, Lee, Melton, Mitsch Bush, Moreno, Pettersen, Primavera, Rosenthal, Ryden, Salazar, Vigil, Williams, Young, Hullinghorst. Concerning education regarding the prevention of child sexual abuse and assault, and, in connection therewith, making an appropriation. Be it enacted by the General Assembly of the State of Colorado: SECTION 1. In Colorado Revised Statutes, 24-33.5-1803, amend (3) (j) and (3) (k); and add (3) (l) as follows: 24-33.5-1803. School safety resource center - created - duties - repeal. (3) The center has the following duties: (j) To provide information and resources relating to the development and maintenance of school resource officer programs, as determined by the center, to the division of fire prevention and control in the department of public safety for distribution to school districts and schools pursuant to section 24-33.5-1213.4 and to law enforcement agencies and other community partners, as described in section 22-32-109.1, C.R.S.; and (k) To provide suggestions for school resource officer training to the peace officers standards and training board, pursuant to section 24-31-312; and (l) To provide materials and training as described in section 24-33.5-1809 to personnel in school districts and charter schools, parents, and students regarding the awareness and prevention of child sexual abuse and assault. SECTION 2. In Colorado Revised Statutes, add 24-33.5-1809 as follows: 24-33.5-1809. Prevention of child sexual abuse and assault - resource bank - training. (1) The director shall appoint a person to the center to collect and provide materials and to provide training to school personnel, parents, and students regarding preventing child sexual abuse and assault, including materials and training that are specific to preventing sexual abuse and assault of children with developmental disabilities. At a minimum, the appointed person shall: (a) Research and select instruction modules for professional development for school personnel that may include, but need not be limited to: (I) Training in preventing, identifying, and responding to child sexual abuse and assault, including information concerning the child abuse reporting hotline system created pursuant to section 26-5-111, C.R.S.; and (II) Resources to raise the awareness of school personnel and parents regarding child sexual abuse and assault and preventing child sexual abuse and assault; (b) Provide training for school personnel and parents in preventing, identifying, and responding to child sexual abuse and assault, including using the child abuse reporting hotline system created pursuant to section 26-5-111, C.R.S. The appointed person may provide training in person or through on-line presentations. (c) Research and select model, age-appropriate educational materials designed for children in grades kindergarten through twelve regarding child sexual abuse and assault awareness and prevention, which may include, but need not be limited to: (I) The skills to recognize: (A) Child sexual abuse and assault; (B) Boundary violations and unwanted forms of touching and contact; and (C) Behaviors that an offender uses to groom or desensitize a victim; and (II) Strategies to: (A) Promote disclosure; (B) Reduce self-blame; and (C) Mobilize bystanders; (d) Publicize to school districts and public and nonpublic schools the availability of the training and resources for school personnel and parents and the age-appropriate education materials for children; and (e) Make the training and resources for school personnel and parents and the age-appropriate education materials for children available on the center's web site. (2) The appointed person shall seek to work with appropriate community-based organizations in creating and collecting the materials, training, and curricula regarding awareness and prevention of child sexual abuse and assault. The appointed person may create and collect materials, curricula, and other resources regarding other forms of child maltreatment and make the materials, curricula, and resources available to school districts and public and nonpublic schools. (3) The person appointed by the director pursuant to this section shall solicit and accept on behalf of the center gifts, grants, and donations to implement this section, as provided in section 24-33.5-1807 (2). Moneys collected pursuant to this subsection (3) shall be transmitted to the state treasurer, who shall credit the moneys to the school safety resource center cash fund created in section 24-33.5-1807. Any moneys received pursuant to this subsection (3) are in addition to appropriations of state moneys to implement this section, and implementing this section is not conditional or dependent on the receipt of gifts, grants, or donations. (4) As used in this section, "school personnel" includes teachers, administrators, school resource officers, and other employees of school districts and public schools. SECTION 3. In Colorado Revised Statutes, 22-32-109.1, add (2.5) as follows: 22-32-109.1. Board of education - specific powers and duties - safe school plan - conduct and discipline code - safe school reporting requirements - school response framework - school resource officers - definitions. (2.5) (a) Safe school plan - child sexual abuse and assault prevention plan. Each school district is encouraged, as part of its safe school plan, to adopt a child sexual abuse and assault prevention plan. Each school district is encouraged to include in the plan delivery of a comprehensive, age-appropriate curricula for kindergarten through twelfth grade regarding child sexual abuse and assault awareness and prevention. The curricula may address, but need not be limited to: (I) The skills to recognize: (A) Child sexual abuse and assault; (B) Boundary violations and unwanted forms of touching and contact; and (C) Behaviors that an offender uses to groom or desensitize a victim; and (II) Strategies to: (A) Promote disclosure; (B) Reduce self-blame; and (C) Mobilize bystanders. (b) Each school district is encouraged to include in the child sexual abuse and assault prevention plan professional development for school personnel and parents in preventing, identifying, and responding to child sexual abuse and assault. Professional development may include providing training in preventing, identifying, and responding to child sexual abuse and assault, including using the child abuse reporting hotline system created pursuant to section 26-5-111, C.R.S., and distributing resources to raise the awareness of school personnel and parents regarding child sexual abuse and assault and preventing child sexual abuse and assault. (c) A school district is encouraged to use curricula and professional development materials, training, and other resources available from the school safety resource center pursuant to section 24-33.5-1809, C.R.S. (d) As used in this subsection (2.5), "school personnel" includes teachers, administrators, school resource officers, and other employees of a school district or a public school. SECTION 4. In Colorado Revised Statutes, add 22-30.5-120 as follows: 22-30.5-120. Charter schools - child sexual abuse and assault plan. (1) Each charter school is encouraged to adopt a child sexual abuse and assault prevention plan. Each charter school is encouraged to include in the plan delivery of a comprehensive, age-appropriate curricula for each grade level that the charter school serves regarding child sexual abuse and assault awareness and prevention. The curricula may address, but need not be limited to: (a) The skills to recognize: (I) Child sexual abuse and assault; (II) Boundary violations and unwanted forms of touching and contact; and (III) Behaviors that an offender uses to groom or desensitize a victim; and (b) Strategies to: (I) Promote disclosure; (II) Reduce self-blame; and (III) Mobilize bystanders. (2) Each charter school is encouraged to include in the child sexual abuse and assault prevention plan professional development for school personnel and parents in preventing, identifying, and responding to child sexual abuse and assault. Professional development may include providing training in preventing, identifying, and responding to child sexual abuse and assault, including using the child abuse reporting hotline system created pursuant to section 26-5-111, C.R.S., and distributing resources to raise the awareness of school personnel and parents regarding child sexual abuse and assault and preventing child sexual abuse and assault. (3) A charter school is encouraged to use curricula and professional development materials, training, and other resources available from the school safety resource center pursuant to section 24-33.5-1809, C.R.S. (4) As used in this section, "school personnel" includes teachers, administrators, school resource officers, and other employees of a charter school. SECTION 5. In Colorado Revised Statutes, add 22-30.5-527 as follows: 22-30.5-527. Institute charter schools - child sexual abuse and assault plan. (1) Each institute charter school is encouraged to adopt a child sexual abuse and assault prevention plan. Each institute charter school is encouraged to include in the plan delivery of a comprehensive, age-appropriate curricula for each grade level that the institute charter school serves regarding child sexual abuse and assault awareness and prevention. The curricula may address, but need not be limited to: (a) The skills to recognize: (I) Child sexual abuse and assault; (II) Boundary violations and unwanted forms of touching and contact; and (III) Behaviors that an offender uses to groom or desensitize a victim; and (b) Strategies to: (I) Promote disclosure; (II) Reduce self-blame; and (III) Mobilize bystanders. (2) Each institute charter school is encouraged to include in the child sexual abuse and assault prevention plan professional development for school personnel and parents in preventing, identifying, and responding to child sexual abuse and assault. Professional development may include providing training in preventing, identifying, and responding to child sexual abuse and assault, including using the child abuse reporting hotline system created pursuant to section 26-5-111, C.R.S., and distributing resources to raise the awareness of school personnel and parents regarding child sexual abuse and assault and preventing child sexual abuse and assault. (3) An institute charter school is encouraged to use curricula and professional development materials, training, and other resources available from the school safety resource center pursuant to section 24-33.5-1809, C.R.S. (4) As used in this section, "school personnel" includes teachers, administrators, school resource officers, and other employees of an institute charter school. SECTION 6. In Colorado Revised Statutes, 22-60.5-110, amend (3) (b) introductory portion as follows: 22-60.5-110. Renewal of licenses. (3) (b) A professional licensee shall complete such ongoing professional development within the period of time for which such professional license is valid. Such professional development may include, but need not be limited to, in-service education programs, including programs concerning juvenile mental health issues and the awareness and prevention of youth suicide and training in preventing, identifying, and responding to child sexual abuse and assault; college or university credit from an accepted institution of higher education or a community, technical, or junior college; educational travel that meets the requirements specified in paragraph (d) of this subsection (3); involvement in school reform; internships; and ongoing professional development training and experiences. The state board of education, by rule, may establish minimum criteria for professional development; except that such criteria shall not: SECTION 7. Appropriation. For the 2015-16 state fiscal year, $72,512 is appropriated to the department of public safety for use by the school safety resource center. This appropriation is from the general fund and is based on an assumption that the department will require an additional 0.9 FTE. To implement this act, the school safety resource center may use this appropriation for program costs. SECTION 8. Safety clause. The general assembly hereby finds, determines, and declares that this act is necessary for the immediate preservation of the public peace, health, and safety. ____________________________ ____________________________ Bill L.
