Summary of Legislation This bill allows the Department of Corrections (DOC) to transfer offenders ages 24 or younger in the custody of the DOC into or out of the Youth Offender System (YOS). Background Under current law, a youthful offender must have been under the age of 19 at the time of the crime and under the age of 21 at the time of sentencing and directly sentenced to the YOS in order to be placed within a YOS facility operated by the DOC. The YOS is capped statutorily at 256 beds and currently has an average daily population of below 200. An offender may be housed in the YOS until he or she turns 24. State Expenditures This bill may incrementally increase or decrease expenditures in the DOC by a minimal amount. The bill does not affect the total number of beds allocated to youthful offenders, but allows DOC management to transfer eligible offenders between a prison and a YOS facility when it deems appropriate. The DOC already transfers offenders between adult prisons for management reasons. For this reason, the fiscal note assumes that administrative workload will not increase and that any incremental increases or decreases between the daily rate between a YOS facility and a DOC facility are minimal and will not require any adjustments in appropriations. Effective Date The bill takes effect August 5, 2015, if the General Assembly adjourns on May 6, 2015, as scheduled, and no referendum petition is filed. State and Local Government Contacts Corrections
