The division of liquor enforcement within the department of revenue is empowered to enforce criminal provisions prohibiting the use, possession, distribution, manufacturing, dispensing, sale, or cultivation of designer drugs. Be it enacted by the General Assembly of the State of Colorado: SECTION 1. In Colorado Revised Statutes, add part 7 to article 35 of title 24 as follows: PART 7 ENFORCEMENT OF PROHIBITIONS AGAINST DESIGNER DRUGS 24-35-701. Enforcement authority - designation of agency - coordination - sharing of information - definitions. (1) The division of liquor enforcement within the department shall have the power to enforce criminal statutes concerning the unlawful use, possession, distribution, manufacturing, dispensing, or sale of any synthetic cannabinoid, as defined in section 18-18-102 (34.5), C.R.S., or any cathinone, as defined in section 18-18-102 (3.5), C.R.S. (2) While enforcing criminal statutes concerning the unlawful use, possession, distribution, manufacturing, dispensing, or sale of any synthetic cannabinoid, as defined in section 18-18-102 (34.5), C.R.S., or any cathinone, as defined in section 18-18-102 (3.5), C.R.S., pursuant to subsection (1) of this section, the division shall coordinate its enforcement with law enforcement agencies to avoid duplicative inspections of the same retailer by multiple agencies. The division shall perform its duties pursuant to subsection (1) of this section within existing resources. SECTION 2. Safety clause. The general assembly hereby finds, determines, and declares that this act is necessary for the immediate preservation of the public peace, health, and safety.
