Bill Summary (Note: This summary applies to this bill as introduced and does not reflect any amendments that may be subsequently adopted. The bill authorizes a school district board of education and the governing board of a charter school to adopt a written policy to allow an employee of the school district or charter school to carry a concealed handgun on school grounds if the person holds a valid permit to carry a concealed handgun. Be it enacted by the General Assembly of the State of Colorado: SECTION 1. In Colorado Revised Statutes, 22-32-110, add (1) (nn) as follows: 22-32-110. Board of education - specific powers. (1) In addition to any other power granted to a board of education of a school district by law, each board of education of a school district shall have the following specific powers, to be exercised in its judgment: (nn) To adopt a written policy that allows an employee of the district to carry a concealed handgun within the buildings, including school buildings, and on school grounds of the school district if the employee holds a valid permit to carry a concealed handgun issued pursuant to part 2 of article 12 of title 18, C.R.S. In addition to holding a valid concealed handgun permit, the policy may include requirements that an employee must meet, including but not limited to completing training. SECTION 2. In Colorado Revised Statutes, add 22-30.5-118 as follows: 22-30.5-118. Charter schools - policies - carrying concealed weapons. The governing board of a charter school may adopt a written policy that allows an employee of the charter school to carry a concealed handgun within the buildings, including school buildings, and on school grounds of the charter school if the employee holds a valid permit to carry a concealed handgun issued pursuant to part 2 of article 12 of title 18, C.R.S. In addition to holding a valid concealed handgun permit, the policy may include requirements that an employee must meet, including but not limited to completing training. SECTION 3. In Colorado Revised Statutes, add 22-30.5-521.5 as follows: 22-30.5-521.5. Institute charter schools - policies - carrying concealed weapons. The governing board of an institute charter school may adopt a written policy that allows an employee of the institute charter school to carry a concealed handgun within the buildings, including school buildings, and on school grounds of the institute charter school if the employee holds a valid permit to carry a concealed handgun issued pursuant to part 2 of article 12 of title 18, C.R.S. In addition to holding a valid concealed handgun permit, the policy may include requirements that an employee must meet, including but not limited to completing training. SECTION 4. In Colorado Revised Statutes, 18-12-214, amend (3) (b); and add (3) (d) and (3) (e) as follows: 18-12-214. Authority granted by permit - carrying restrictions. (3) A permit issued pursuant to this part 2 does not authorize a person to carry a concealed handgun onto the real property, or into any improvements erected thereon, of a public elementary, middle, junior high, or high school; except that: (b) A permittee who is employed or retained by contract by a school district or charter school as a school security officer may carry a concealed handgun onto the real property, or into any improvement erected thereon, of a public elementary, middle, junior high, or high school while the permittee is on duty; (d) A permittee who is an employee of a school district may carry a concealed handgun onto the real property, or any improvements erected thereon, of a public elementary, middle, junior high, or high school of the school district if the permittee is carrying the concealed handgun in accordance with a written policy adopted by the school district board of education pursuant to section 22-32-110 (1) (nn), C.R.S. (e) A permittee who is an employee of a charter school that is an elementary, middle, junior high, or high school may carry a concealed handgun onto the real property, or any improvements erected thereon, of the charter school if the permittee is carrying the concealed handgun in accordance with a written policy adopted by the governing board of the charter school pursuant to section 22-30.5-118 or 22-30.5-521.5, C.R.S., whichever is applicable. SECTION 5. Safety clause. The general assembly hereby finds, determines, and declares that this act is necessary for the immediate preservation of the public peace, health, and safety.
