Concerning the percentage at which to rate the student academic growth standard for the purpose of licensed personnel performance evaluations in the 2014-15 academic year. Be it enacted by the General Assembly of the State of Colorado: SECTION 1. In Colorado Revised Statutes, 22-9-106, amend (2.5) (b) as follows: 22-9-106. Local boards of education - duties - performance evaluation system - compliance - rules - repeal. (2.5) (b) (I) The council shall actively participate with the local board in developing written standards for evaluation that clearly specify performance standards and the quality standards and the criteria to be used to determine whether the performance of each licensed person meets such standards pursuant to paragraph (e) of subsection (1) of this section. Except as provided in subparagraph (II) of this paragraph (b), this paragraph (b) shall take takes effect at such time as the performance evaluation system based on quality standards established pursuant to this section and the rules promulgated by the state board pursuant to section 22-9-105.5 has completed the initial phase of implementation and has been implemented statewide. The commissioner shall provide notice of such implementation to the revisor of statutes on or before July 1, 2014, and each July 1 thereafter until statewide implementation occurs. (II) (A) For the 2014-15 academic year and every year thereafter, a local board shall implement a licensed personnel evaluation system based on the quality standards established pursuant to this article and rule of the state board, including student academic growth; except that, for the 2014-15 academic year only, a local board may determine at what percentage, if any, to weigh student academic growth toward the final level of effectiveness assigned to any person receiving an evaluation pursuant to this article. In no instance may a local board weigh student academic growth, as used in determining a final level of effectiveness, at greater than fifty percent. (B) This subparagraph (II) is repealed, effective July 1, 2015. SECTION 2. Safety clause.
