The bill modifies the definition of "public records" under the "Colorado Open Records Act" to include all writings made, maintained, or kept by a private association whose membership consists primarily of elected officials of one or more political subdivisions of the state or individuals holding a covered state office, as applicable, and that receives at least 10% of its revenues on an annual basis from public moneys. Be it enacted by the General Assembly of the State of Colorado: SECTION 1. In Colorado Revised Statutes, 24-72-202, add (6) (a) (V) as follows: 24-72-202. Definitions. As used in this part 2, unless the context otherwise requires: (6) (a) (V) "Public records" include, without limitation, all writings made, maintained, or kept by a private association whose membership consists primarily of either individuals holding a covered state office or elected officials of one or more political subdivisions and that receives at least ten percent of its revenues on an annual basis from public moneys. For purposes of this section, "covered state office" has the same meaning as in section 24-6-203 (1) (c). SECTION 2. Act subject to petition - effective date - applicability. (1) This act takes effect September 1, 2014; except that, if a referendum petition is filed pursuant to section 1 (3) of article V of the state constitution against this act or an item, section, or part of this act within the ninety-day period after final adjournment of the general assembly, then the act, item, section, or part will not take effect unless approved by the people at the general election to be held in November 2014 and, in such case, will take effect on the date of the official declaration of the vote thereon by the governor. (2) This act applies to requests for records submitted on or after the applicable effective date of this act.
