Bill Summary (Note: This summary applies to this bill as introduced and does not reflect any amendments that may be subsequently adopted. The bill suspends, until January 1, 2016, the provisions of House Bill 13-1303. Until that date, elections laws, as they would have existed absent passage of House Bill 13-1303, are in full force and effect. Be it enacted by the General Assembly of the State of Colorado: SECTION 1. Legislative declaration. (1) The general assembly hereby finds, determines, and declares that the purpose of this act is to suspend, until 2016, the provisions of House Bill 13-1303, also known as the "Voter Access and Modernized Elections Act". Until that time, it is the general assembly's intent that elections laws, as they would have existed absent passage of House Bill 13-1303, be in effect. The general assembly intends that House Bill 13-1303 automatically take effect again on January 1, 2016, and apply to elections conducted on and after that date. (2) The general assembly also recognizes that other acts pertaining to elections laws were passed during the 2013 legislative session, and other such acts will be passed during the 2014 and 2015 legislative sessions. The general assembly therefore clarifies that this act is not intended to cause any other elections laws lawfully enacted during or subsequent to the 2013 session to be suspended or, to the greatest extent possible, altered. (3) The general assembly further declares that this act is not intended to, and does not, affect the validity of elections conducted or voter registrations effected between the passage of House Bill 13-1303 and the effective date of this act. SECTION 2. In Session Laws of Colorado 2013, amend section 140 of chapter 185 as follows: Section 140. Applicability. (1) This act applies to elections conducted on or after the effective date of this act from May 10, 2013, to the effective date of Senate Bill 14-_____, and to elections conducted on or after January 1, 2016. (2) This act does not apply to elections conducted from the effective date of Senate Bill 14-_____ through December 31, 2015. SECTION 3. In Session Laws of Colorado 2013, amend section 141 of chapter 185 as follows: Section 141. Effective date. (1) Except as otherwise provided in subsection (2) of this section, this act takes effect upon passage. (2) (a) Section 1-1-115 (2) (c) (I), Colorado Revised Statutes, as enacted in section 5 of this act, takes effect only if House Bill 13-1079 becomes law and takes effect on the effective date of this act or House Bill 13-1079, whichever is later This act is effective from May 10, 2013, to the effective date of Senate Bill 14-_____, and is effective on and after January 1, 2016. (b) Section 1-1-115 (2) (c) (II), Colorado Revised Statutes, as enacted in section 5 of this act, takes effect only if House Bill 13-1079 does not become law. (c) Section 1-2-205 (2), Colorado Revised Statutes, as enacted in section 12 of this act, takes effect only if House Bill 13-1135 becomes law and takes effect on the effective date of this act or House Bill 13-1135, whichever is later. (d) Sections 13 and 14 of this act take effect only if House Bill 13-1135 does not become law. SECTION 4. Applicability. This act applies to elections conducted between the effective date of this act and January 1, 2016. SECTION 5. Safety clause. The general assembly hereby finds, determines, and declares that this act is necessary for the immediate preservation of the public peace, health, and safety.
