Current law permits a Colorado-licensed spirituous liquors manufacturer to conduct tastings and sell on its licensed premises only spirituous liquors manufactured by the licensee. The bill permits a licensed manufacturer to conduct tastings and sell spirits manufactured by another Colorado-licensed manufacturer and to offer tastings of raw ingredients used in its manufacturing process. Be it enacted by the General Assembly of the State of Colorado: SECTION 1. In Colorado Revised Statutes, 12-47-103, amend (37.5) as follows: 12-47-103. Definitions. As used in this article and article 46 of this title, unless the context otherwise requires: (37.5) "Tastings" means the sampling of malt, vinous, or spiritous liquors that may occur: (a) On the premises of a retail liquor store licensee or liquor-licensed drugstore licensee by adult patrons of the licensee pursuant to the provisions of section 12-47-301 (10); (b) On the premises or at a licensed sales room location of a licensed manufacturer pursuant to section 12-47-402 (2) or (6) (a); or (c) On the premises of a licensed limited winery pursuant to section 12-47-403 (2) (e). SECTION 2. In Colorado Revised Statutes, 12-47-301, amend (10) (f) as follows: 12-47-301. Licensing in general. (10) (f) Nothing in this subsection (10) shall affect affects the ability of a Colorado winery licensed pursuant to section 12-47-402 or 12-47-403 to conduct a tasting pursuant to the authority of section 12-47-402 (2) or 12-47-403 (2) (e) or a manufacturer of spirituous liquors licensed pursuant to section 12-47-402 (1) to conduct a tasting pursuant to section 12-47-402 (6) (a). SECTION 3. In Colorado Revised Statutes, 12-47-402, amend (6) (a) as follows: 12-47-402. Manufacturer's license. (6) (a) Any manufacturer of spirituous liquors that has received a license is licensed pursuant to this section is authorized to may conduct tastings and sell to customers spirituous liquors of its own manufacture, including tastings of the raw ingredients used to manufacture its spirituous liquors, and may conduct tastings and sell spirituous liquors manufactured by other Colorado manufacturers licensed pursuant to this section, on its licensed premises and at one other licensed sales room location at no additional cost. Such An additional sales room location may be included in the manufacturer's license at the time of the original license issuance is issued or by supplemental application. SECTION 4. Safety clause. The general assembly hereby finds, determines, and declares that this act is necessary for the immediate preservation of the public peace, health, and safety.
