SENATE BILL 14-041 BY SENATOR(S) Herpin, Balmer, Baumgardner, Cadman, Crowder, Grantham, Guzman, Heath, Kerr, King, Lambert, Lundberg, Marble, Rivera, Scheffel, Todd, Zenzinger, Carroll; also REPRESENTATIVE(S) Gardner and Swalm, Fields, Gerou, Ginal, Labuda, Landgraf, Lebsock, McNulty, Melton, Pabon, Peniston, Priola, Rosenthal, Ryden, Salazar, Scott, Wilson, Wright. Concerning the creation of a USS Colorado license plate for motor vehicles, and, in connection therewith, making an appropriation. Be it enacted by the General Assembly of the State of Colorado: SECTION 1. In Colorado Revised Statutes, 42-3-213, amend (1) (a) (XXV) and (1) (a) (XXVI); and add (1) (a) (XXVII) and (28) as follows: 42-3-213. Special plates - military veterans - rules - retirement. (1) (a) The department shall issue one or more sets of special license plates to the following persons who own a truck that does not exceed sixteen thousand pounds empty weight, a passenger car, a motorcycle, or a noncommercial or recreational vehicle: (XXV) An honorably discharged, retired, reserve, or active member of the Navy SEALs; or (XXVI) A natural person who supports the civil air patrol; or (XXVII) A natural person who supports the USS Colorado (SSN 788). (28) USS Colorado. (a) The department of military affairs may design the USS Colorado (SSN 788) license plate if the design conforms with standards established by the department. The plate must indicate that an owner of a motor vehicle to which the plate is attached supports the USS Colorado submarine. (b) A natural person who supports the USS Colorado (SSN 788) may use USS Colorado license plate. SECTION 2. Appropriation. (1) In addition to any other appropriation, there is hereby appropriated, out of any moneys in the Colorado state titling and registration account of the highway users tax fund created in section 42-1-211 (2), Colorado Revised Statutes, not otherwise appropriated, to the department of revenue, for the fiscal year beginning July 1, 2014, the sum of $4,120, or so much thereof as may be necessary, to be allocated for the purchase of computer programming services related to the implementation of this act. (2) In addition to any other appropriation, there is hereby appropriated, out of any moneys in the license plate cash fund created in section 42-3-301 (1) (b), Colorado Revised Statutes, not otherwise appropriated, to the department of revenue, for the fiscal year beginning July 1, 2014, the sum of $1,658, or so much thereof as may be necessary, for allocation to the division of motor vehicles for the purchase of special license plates related to the implementation of this act. (3) In addition to any other appropriation, there is hereby appropriated to the governor - lieutenant governor - state planning and budgeting, for the fiscal year beginning July 1, 2014, the sum of $4,120, or so much thereof as may be necessary, for allocation to the office of information technology, for the provision of computer center services for the department of revenue related to the implementation of this act. Said sum is from reappropriated funds received from the department of revenue out of the appropriation made in subsection (1) of this section. SECTION 3. Act subject to petition - effective date - applicability. (1) This act takes effect at 12:01 a.m. on the day following the expiration of the ninety-day period after final adjournment of the general assembly (August 6, 2014, if adjournment sine die is on May 7, 2014); except that, if a referendum petition is filed pursuant to section 1 (3) of article V of the state constitution against this act or an item, section, or part of this act within such period, then the act, item, section, or part will not take effect unless approved by the people at the general election to be held in November 2014 and, in such case, will take effect on the date of the official declaration of the vote thereon by the governor.
