The bill establishes as a deceptive trade practice under the "Colorado Consumer Protection Act" the use of the titles "veterinary technician", "certified veterinary technician", or "veterinary technician specialist" followed by a specialty designation, or the abbreviations for those titles if the person does not possess the specified education, has not passed the designated examination, or has not been certified in the designated specialty. Be it enacted by the General Assembly of the State of Colorado: SECTION 1. In Colorado Revised Statutes, 6-1-707, add (1) (f) as follows: 6-1-707. Use of title or degree - deceptive trade practice. (1) A person engages in a deceptive trade practice when, in the course of such person's business, vocation, or occupation, such person: (f) Claims either orally or in writing to be a: (I) "Certified veterinary technician" or uses the abbreviation "C.V.T." or "CVT" to indicate that the person is a certified veterinary technician unless the person: (A) Has graduated from a program in veterinary technology that is accredited by the American veterinary medical association or its successor organization; (B) Has passed a veterinary technician national examination administered by the American association of veterinary state boards or its successor entity; and (C) Maintains good standing and obtains appropriate continuing education credits as established by the Colorado association of certified veterinary technicians or its successor organization; or (II) "Veterinary technician specialist" or uses the abbreviation "V.T.S." or "VTS", followed by a specialty designation, to indicate that the person is a credentialed veterinary technician who has completed a formal process of education, training, experience, and testing to qualify for a specialty certification through the national association of veterinary technicians in America or its successor organization. SECTION 2. Act subject to petition - effective date. This act takes effect at 12:01 a.m. on the day following the expiration of the ninety-day period after final adjournment of the general assembly (August 6, 2014, if adjournment sine die is on May 7, 2014); except that, if a referendum petition is filed pursuant to section 1 (3) of article V of the state constitution against this act or an item, section, or part of this act within such period, then the act, item, section, or part will not take effect unless approved by the people at the general election to be held in November 2014 and, in such case, will take effect on the date of the official declaration of the vote thereon by the governor.
