      Concerning elimination of the waiting period for children's
           eligibility under the children's basic health plan.
       
      
      Be it enacted by the General Assembly of the State of Colorado:
      
           SECTION 1.  In Colorado Revised Statutes, 25.5-8-109, amend (1)
      as follows:
      
           25.5-8-109.  Eligibility - children - pregnant women. (1)  To be
      eligible for a subsidy, a child must not have currently nor in the three
      months prior to application for the plan have been be insured by a
      comparable health plan through an employer. with the employer
      contributing at least fifty percent of the premium cost. Children who have
      lost insurance coverage due to a change in or loss of employment shall not
      be subject to the waiting period.
      
           SECTION 2.  Safety clause. The general assembly hereby finds,
      determines, and declares that this act is necessary for the immediate
      preservation of the public peace, health, and safety.
