The bill allows a board of county commissioners for a particular county to exclude, by resolution, any or all parts of the county from the enhanced motor vehicle emissions program area if the excluded part of the county does not violate any national ambient air quality standard for carbon monoxide or ozone as established by the environmental protection agency. Be it enacted by the General Assembly of the State of Colorado: SECTION 1. In Colorado Revised Statutes, 42-4-304, amend (20) (c) (I); and add (20) (c) (IV) as follows: 42-4-304. Definitions relating to automobile inspection and readjustment program - rules. As used in sections 42-4-301 to 42-4-316, unless the context otherwise requires: (20) (c) (I) Effective January 1, 2010, The enhanced emissions program area shall consist consists of the counties of Adams, Arapahoe, Boulder, Douglas, Jefferson, Larimer, and Weld, and the cities and counties of Broomfield and Denver as described in paragraph (a) of this subsection (20) and subject to paragraph (d) of this subsection (20) Notwithstanding any other provision of this section, vehicles registered in the counties of Larimer and Weld shall not be required to obtain a certificate of emissions control prior to July 1, 2010, in order to be registered or reregistered and subparagraph (IV) of this paragraph (c). (IV) A board of county commissioners for a particular county may exclude, by resolution, any or all parts of the county from the enhanced emissions program area if the excluded part of the county does not violate any national ambient air quality standard for carbon monoxide or ozone as established by the environmental protection agency. SECTION 2. Act subject to petition - effective date. This act takes effect at 12:01 a.m. on the day following the expiration of the ninety-day period after final adjournment of the general assembly (August 7, 2013, if adjournment sine die is on May 8, 2013); except that, if a referendum petition is filed pursuant to section 1 (3) of article V of the state constitution against this act or an item, section, or part of this act within such period, then the act, item, section, or part will not take effect unless approved by the people at the general election to be held in November 2014 and, in such case, will take effect on the date of the official declaration of the vote thereon by the governor.
